PUBLIC WORKS AND PROPERTY VACATION JULY 8, 2013 <br />3:30 P.M. <br />Committee Members Present: Oliver Davis, Dr. David Varner (5:44) Gavin Ferlic <br />Other Council Members Present: Tim Scott, Henry Davis, Dr. Fred Ferlic, Karen White, <br />Derek Dieter <br />Others Present: Chief Steve Cox, Kathryn Roos, Mike Mecham, Eric Horvath, Kathleen <br />Cekanski - Farrand, John Voorde <br />Agenda: Bill No. 30 -13 Vacate Alleys & Streets bounded by Sample St. High St. and Railroad <br />Tracks <br />Chairperson Oliver Davis opened his Public Works & Property Vacation Committee hearing <br />promptly at the 3:30 scheduled time without a quorum. Valerie Schey was out of town. Dr. David <br />Varner would arrive at 3:44 to make a quorum. <br />The first item on the agenda Bill No. 30 -13, was a request to vacate streets and alleys on the site <br />of the proposed fire department training facility. City Engineer Mike Mecham using a poster <br />board diagram made the presentation. <br />During Council Q & A Derek Dieter asked if there would be any open burning. Fire Chief Steve <br />Cox said there would only be propane burning. All wood and petroleum burns would be in the <br />County at the Clay Fire Department site. Councilmember Tim Scott asked what type of fence <br />would surround the site. The Chief said chain link. Councilmember Gavin Ferlic disclosed he is <br />an attorney for Burkhart Outdoor Advertising which has a billboard on the property; but said this <br />employment does not constitute a conflict of interest. Council Attorney Kathleen Cekanski <br />Farrand asked Chief Cox what the timetable to completion looked like. Chief Cox said bids would <br />be opened by the BPW on July 16, and awarded on July 23. Construction would be substantially <br />complete by January 14, 2014 and finished by June 2014. <br />Due to lack.of a quorum at first, no recommendation was given though after Varner's arrival the <br />question was revisited. At that time on a motion by Gavin Ferlic seconded by David Varner, the <br />bill went to full Council favorably without dissent. <br />The second agenda item was a report from Director of Public Works, Eric Horvath on the situation <br />at the LaFayette Falls Subdivision. In brief, the developer Weiss Homes has filed for bankruptcy <br />failing to complete the public infrastructure component of the project. The Council was asked by <br />the homeowners to intervene. Mr. Horvath's update follows that request. <br />Mr. Horvath said the City had met with Weiss. IDEM extended storm water requirements to July <br />1. Paving completion at an estimated cost of $151,000 and retention pond work estimated to cots <br />$61,000 would begin as soon as Weiss produced $175,000 to pay contractors for the work. <br />Performance bonds in the amount of $250,000 would be pursued if the $175,000 was not in <br />hand.
