REGULAR MEETING NOVEMBER 9, 1959 <br />amend the Ordinance by attaching the following conditions: <br />1. That a parcel of land between 4 and 5 acres in area be reserved for a period of time <br />not to exceed three years for acquisition through purchase by or gift to the City of <br />South Bend. <br />2. That the location of said land be subject to the approual of the Board of Park Commissioners. <br />3. That said land if not dedicated to the City of South Bend be sold to the City at the average <br />cost per acre to the developer at the time of the developer's purchase. <br />Councilman Kroll seconded the motion. Motion carried. <br />Councilman Kroll made a motion that the Ordinance, as amended, be set for public hearing on November 23, 1959, <br />Councilman Hahn seconded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE REGULATING THE ERECTION, CONSTRUCTION, REPAIR, ALTERATION, <br />LOCATION, OF ALL ELECTRIC SIGNS; LOCATION OF ALL OVERHANGING SIGNS AND <br />ALL TYPES OF ELECTRIFIED SIGNS WITHIN TIE CITY OF SOUTH BEND, INDIANA: <br />PROVIDING FOR THE POSTING OF BONDS, LICENSING OF SIGN CONTRACTORS: THE <br />ISSUANCE OF PERMITS AND FEES THEREFORE; AND PROVIDING FOR MINIMU14 <br />CONSTRUCTION STANDARDS. <br />159 <br />Councilman Kroll made a motion that the Ordinance be referred to the Committee of the Whole to be considered along <br />with the Building Code Ordinance which is now in the Committee of the Whole. Councilman Erler seconded the motion. <br />Motion carried. <br />ORDINANCE <br />AN ORDINANCE FOR ADDITIONAL - APPROPRIATIONS IN STREET DEPARTMENT $16,800.00 <br />AND CITY PLANNING $1,120.00: MORRIS MUNICIPAL AUDITORIUM DEPARTMENT $9,896.64; <br />FIRE DEPARTMENT $900.00; SEWER DEPARTMENT $3,500.00; BOARD OF WORKS AND <br />SAFETY $1,500.00 AND OFFICE OF CITY JUDGE $150.00 <br />The Ordinance was given first reading by title and second reading in full. Councilman Kroll made a motion that the <br />Ordinance be set for Public Hearing on November 23, 1959. Councilman Hahn seconded the motion. Motion carried. <br />REPORT OF PUBLIC IMPROVEMENTS COMMITTEE ON HOUSING RESOLUTION <br />IN RE: RESOLUTION APPROVING APPLICATION FOR PRELIMINARY LOAN FOR LOW -RENT PUBLIC HOUSING <br />The Public Improvements Committee consisting of Donald F. Erhardt, Chairman, and Chester Muszynski, Walter Glass and <br />Julius B. Christman, Jr., met November 9th and are of the opinion that this Resolution should have been referred to <br />the Housing Committee instead of Public Improvement Committee. Therefore, this committee refers this Resolution <br />to the Council without recommendation. <br />Councilman Kroll made a motion that the report be accepted and placed on file. Councilman Glass seconded the motion. <br />Motion carried. <br />Councilman Erler made a motion that the Resolution be referred to the Special Housing Committee. Councilman Glass <br />seconded the motion. Upon roll call the motion was lost by a vote of 6 nays, 3 ayes. (Councilmen Christman, Glass <br />Erler). Mr. Joel Bullard, Realtor Board President, requested that the Resolution be set for public hearing. <br />Councilman Kroll then moved that the Reolution be read at this meeting. Councilman Muszynski seconded the motion. <br />Motion carried. <br />The Clerk then read the Resolution in its entirety. Councilman Kroll made a motion for adoption of the Resolution. <br />Councilman Muszynski seconded the motion. Motion carried and the Resolution was adopted upon roll call vote of <br />6 ayes and 3 nays, (Councilmen Christman, Glass and Erler). <br />NEW BUSINESS <br />Councilman Glass stated that merchants and residents of East Sample Street had been inquiring -as to the length of t <br />Sample Street would be closed to traffic and if there is a possibility of it being opened to traffic even though <br />no more work is going to be done on the project until next spring. Mr. Irving Smith, City Attorney, stated that he <br />had been informed that Sample Street would be opened to traffic soon but directed the Clerk to ask Mr. Andrysiak, <br />City Engineer, to appear before the Council at their next regular meeting to explain the plans for the project. <br />A complaint was received concerning the use of the property at the southeast corner of Columbia Street and Dubail <br />Street relative to a non - confoming use of the zoning Ordinance. The Clerk was directed to ask Mr. William McInerny, <br />Attorney for the Board of Zoning Appeals, to appear before the Council at their next regular meeting to explain to <br />the Council variances and non- confoming use. <br />There being no further business to come before the Council, Councilman Kroll made a motion to adjourn. Councilman <br />Hahn seconded the motion. Motion carried and the Regular Meeting of the Common Council adjourned at 9 :29 P.M. <br />ATTEST: APPROVED: <br />CLERK I/ PRES <br />
