Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council <br />Chambers, Monday, July 13, 1959, at 8 :41 P.M., with all members present except Councilmen Korpal and Tellson. The <br />meeting was called to order by Vice President William A. Hahn, who presided in the absence of President Korpal. <br />ROLL CALL: PRESENT: Councilmen Erhardt, Christman, Kroll, Glass, Hahn, Erler and Muszynski. <br />ABSENT: Councilmen Korpal and Tellson. <br />MINUTES <br />Report of Committee on Minutes <br />To the Common Council of the City of South Bend: <br />Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspectE <br />the minutes of the previous meeting of the Council and found them correct. Motion carried. <br />REPORT OF BUILDING DEPARTMENT <br />Common Council of the <br />Civil City of South Bend, Indiana <br />Attention: City Clerk - City Hall <br />Gentlemen: <br />July 13, 1959 <br />In response to your request, I am submitting herein a report on possible violation of those ordinances under my <br />jurisdiction perpetrated by the owner(s) /and or occupant of the property located on the North East corner of Lincoln- <br />way East and Twyckenham Drive in the City of South Bend, Indiana. <br />Please.be advised that I have investigated the subject property and have found the following. <br />1. That 185 feet of frontage on Lincolnway East on the North side of said street is zoned "B" Residential as to use. <br />2. That the property is presently occupied by the firm known as Allied Motor Sales Used Cars and is more specifically <br />defined as that property fronting on Lincolnway East on North side of said street and bounded by the East line of <br />Caroline Street extended, West to the East line of Twyckenham Drive. <br />3. That the property is presently occupied for the purpose of resale of used automobiles and is presently being sub- <br />let for the purpose of commercial advertising. <br />4. That the aforesaid use of the property, as defined in part 3, is a violation of Ordinance #3702, Section No. 4, <br />as such pertains to permissable uses on property zoned "B" Residential as to use. <br />Consequently, I hereby assure you that action will be taken by this Department, insofar as it is capable, of insuring' <br />compliance with said zoning ordinance. <br />However, there exists the possibility that there may have been further violation of other ordinances of this City <br />by virtue of the fact that some evidence exists which indicates that a portion of the natural river bed has been <br />filled in for the purpose of extending the illegal commercial use. Since this possible violation does not come <br />within the realm of police powers designated to this Department, we shall refer this matter to the Park Department <br />and to the Board of Public Works and Safety for their consideration, with a recommendation for possible remedial <br />action. <br />I trust that this information will answer satisfactorily any question which you may have had pertaining to the <br />subject property, but if you should have further question, please contact me. <br />VLL: bb <br />Yours truly; <br />/s/ Verner L.
