J <br />COMMITTEE OF THE WHOLE MEETING <br />MAY 25, 1959 A <br />107 <br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole in the <br />Council Chambers is the City Hall on Monday, May 25, 1959, at 8:33 P.M., with all members present. The meeting was <br />called to order by Councilman Kroll, Chairman, who presided. <br />ORDINANCE <br />AN ORDINANCE PROVIDING FOR THE ANNEXATION OF CERTAIN TERRITORY <br />TO THE CITY OF SOUTH BEND, INDIANA (Clay Township) <br />Public Hearing was held on the above Ordinance. Proponents and opponents were given an opportunity to be heard. <br />Speaking against the proposed Ordinance were the following: <br />Joseph Puca, 17380 Wilshire <br />0. E. Carter, 17523 Hepler Street <br />Edward M. Larson, 17037 E. Bulla <br />Charles E. Evans, 19770 E. Kern Road, President of Hoosier Suburbia <br />Speaking in favor of the Ordinance was Earl Kime, General Manager of Portage Realty Corporation. <br />In Rebuttal, Charles E. Evans spoke. <br />Councilman Hahn made a motion that the Ordinance go to the Council as favorable. Councilman Muszynski seconded the <br />motirn. Motion carried. <br />ORDINANCE <br />AN ORDINANCE TO AMEND ORDINANCE NO. 3709, AS AMENDED, WHICH <br />ORDINANCE IS COMMONLY KNOWN AS ZONING ORDINANCE OF THE CITY <br />OF SOUTH BEND, INDIANA (West Ewing Avenue) <br />Public Hearing was held on the above Ordinance. Proponents and opponents were given an opportunity to be heard. <br />Councilman Hahn made a motion that the Ordinance go to the Council as favorable. Councilman Korpal seconded the <br />motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 <br />(Land at East Jefferson and Eddy Street) <br />Public Hearing was held on the above Ordinance. Proponents and opponents were given an opportunity to be heard. <br />Speaking against the proposed Ordinance were the following: <br />Robert BonDurant, 1130 East Jefferson Boulevard <br />Paul M. Butler, 1718 East Jefferson Boulevard <br />Joseph T. Helling, Attorney, representing Mrs. Lillian Studebaker and daughters. <br />Samuel Fiewell, Attorney, representing Harry Rosenstein, Dr. E. Liss and Mr. Bernard Berman <br />Russell Kuehl, Attorney, representing Mrs. W. W. Austin, 1243 East Jefferson Boulevard <br />Lenn J. Oare, Attorney, representing Mrs. E. M. Morris <br />Speaking in favor of the proposed Ordinance were the following: <br />Nicholas P. Cholis,- Attorney, representing Richard A. Muessel, Jr. <br />Joseph A. Roper, Attorney, representing Mr. Muessel. <br />In Rebuttal, Mr. Paul M. Butler was heard. <br />In Counter - rebuttal, Mr. Joseph A. Roper, Attorney, was heard. <br />Councilman Tellson made a motion that the proposed Ordinance go to the Council as unfavorable. Councilman Glass <br />seconded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE ANNEXING TO THE CITY OF SOUTH BEND CERTAIN TERRITORY <br />CONTIGUOUS THERETO (Land adjacent to Broadmoor) <br />Public hearing was held on the above Ordinance. Proponents and opponents were given an opportunity to be heard. <br />Speaking against the proposed Ordinance was Charles E. Evans 19770 East Kern Road, President of Hoosier Suburbia. <br />Speaking in favor of the Proposed Ordinance was William E. Voor, Attorney, representing the Hilton Construction Com- <br />pany. <br />Councilman Hahn made a motion that the proposed Ordinance go to the Council as favorable. Councilman Korpal seconded <br />the motion. Motion carried. <br />There being no further business to come before the Committee of the Whole, Councilman Hahn made a motion to adjourn. <br />Councilman Glass seconded the motion.
