Dieter <br />Council Member Oliver Davis <br />• Currently pending in the Health & Public Safety Committee <br />• Public Hearing and Council Action to take place on Monday, July 22, 2013 <br />• Reviewed Indiana state law and ordinances in effect in: <br />Kokomo, Indiana - June 22, 2013 Kokomo Tribune article attached <br />Muncie, Indiana <br />Richmond City, Indiana <br />Terre Haute, Indiana <br />• Requires annual registration with South Bend Police Department <br />• $20 initial registration fee thereafter $15 annual renewal fee <br />Compliments Indiana state law which already prohibits anyone under 15 years of age to operate a <br />moped, prohibits mopeds on interstate highways & sidewalks, prohibits going faster than 25 mph, <br />requires protective headgear, glass, goggles or transparent face shield if under 18 years of age with state <br />violations being a Class C Infraction. Local city safety regulations would: <br />—� Require tail & brake lights & headlamp must be on at all times when in operation <br />—� No passengers on mopeds <br />—� No mopeds in bike lanes <br />-� Require a valid registration decal affixed to the moped which has been issued by SBPD <br />• Any business which rents mopeds must have protective headgear & opportunity to purchase insurance <br />• $50 fine for 1" violation; $100 fine for each violation thereafter, impoundment for lack of registration <br />decal or failure to required safety equipment is not in compliance <br />• 50% of fines & fees earmarked for the Police Department's Law Enforcement Continuing Education <br />Fund (Fund # 220) <br />• Continuing to work with SBPD and Administration so that there will be proper implementation and <br />education outreach to the general public/ PSAs on safety <br />• Effective October 1, 2013 <br />
