the Board of Public works the possibility of placing at least one shade -type tree in front of the <br />building, most likely in the right -of -way. Staff also recommends denial of the variance to <br />provide no parking spaces. Considering the wide range of potential future uses and the fact <br />that the curb cut for this project will actually reduce the availability of on street parking, some <br />off street parking should be provided. While the site is not conducive to the required 18 parking <br />spaces, it appears that there will be adequate room at the rear of the site to provide some off <br />street parking. <br />Special Exception / Special Use <br />A special exception use / special use may only be granted upon making a written <br />determination and adopting appropriate Findings of Fact, based upon the evidence presented <br />at a public hearing, that <br />(1) The proposed use will not be injurious to the public health, safety, comfort, <br />community moral standards, convenience or general welfare; <br />(2) The proposed use will not injure or adversely affect the use of the adjacent area or <br />property values therein; <br />(3) The proposed use will be consistent with the character of the district in which it is <br />located and the land uses authorized therein; <br />(4) The proposed use is compatible with the recommendations of the Comprehensive <br />Plan. <br />11. Petition of Hannah & Friends Neighborhood, Inc. <br />Based on information available prior to the Board meeting, the Staff recommends approval of <br />the revised site plan for the previously approved Special Use. <br />(1) The proposed use will not be injurious to the public health, safety, comfort, community <br />moral standards, convenience or general welfare. <br />The addition of the activity center will not impact the public. The proposed activity center <br />is located over 650' from the nearest public access point and will be used solely for the <br />residents of the development. <br />(2) The proposed use will not injure or adversely affect the use of the adjacent area or <br />property values therein. <br />The proposed use is located 320' feet from the adjacent property owner to the north and <br />well within the development so it will not have any visual or other impact on the adjacent <br />property owners. <br />(3) The proposed use will be consistent with the character of the district in which it is <br />located and the land uses authorized therein. <br />The addition of an activity center and greenhouse will be consistent with the original <br />intent of the site and the established character of the general neighborhood. <br />(4) The proposed use is compatible with the recommendations of the Comprehensive Plan. <br />The Comprehensive Plan for South Bend and St. Joseph County, Indiana (April 2002) <br />Goal 3, Objective A is Promote the development and /or maintenance of community and <br />neighborhood character. <br />13. Petition of JOYS Gymnastics Inc.. <br />Based on information available prior to the Board meeting, the Staff recommends that the <br />Special Use be sent to the Common Council with a favorable recommendation. <br />(1) The proposed use will not be injurious to the public health, safety, comfort, community <br />moral standards, convenience or general welfare. <br />SERVING ST.
