Michigan Streets and 200 feet, more or less, north of Albert Street, being recently annexed land to the City of <br />South Bend, Indiana, to "C" Commercial Use District and "A" Height and Area District was legally advertised on May 26,' <br />1958 and given public hearing under date of 5 June 1958. The following action was taken: <br />After due consideration the Commission found that substantial justice would be done by the favorable <br />recommendation of the petition. It was therefore duly moved, seconded, and unanimously carried that <br />the petition be recommended favorably to the Common Council. <br />Very truly yours, <br />CITY PLANNING COMMISSION <br />Is/ Robert L. Councilman Erler seconded the motion. <br />Motion carried. <br />REPORT OF THEc'CITY PLANNING COMMISSION: <br />The Honorable Common Council <br />City Of South Bend <br />South Bend, Indiana <br />Gentlemen: <br />June 9, 1958 <br />The attached petition of Edward and Virginia Buszkiewicz to rezone Lot Numbered 2 in Wooded Estates from "A "Resident <br />Use District to "C" Commercial Use District and "A" Height and Area District was legally advertised on May 26, 1958 <br />and given public hearing under date of 5 June 1958. Motion carried, <br />ORDINANCE NO. 4231 <br />AN ORDINANCE TO AMEND ORDINANCE NO. 3702, AS AMENDED, WHICH ORDINANCE IS <br />COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA <br />The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for <br />suspension of rules: Councilman Hahn seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. <br />The Ordinance was then given third reading and passed by a roll call vote of 9 ayes 0 nays. <br />ORDINANCE NO. 4232 <br />AN ORDINANCE TO CHANGE_THE NAME OF SEABURY DRIVE IN THE CITY OF SOUTH BEND <br />TO ST, JOHNS WAY, <br />The Ordinance was given first reading by title and second reading in full. Councilman Kroll made a motion for <br />suspension of rules. Councilman Carr seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. <br />The Ordinance was then given third reading and passed by a roll call vote of 9 ayes, 0 nays. <br />ORDINANCE <br />AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND $260.00 TO OFFICE OF CITY <br />JUDGE ACCOUNT NO. E -725 OFFICE EQUIPMENT (Three floor fans and one table) <br />ALL OF THE BUDGET FOR THE CIVIL CITY OF SOUTH BEND, INDIANA FOR 1958, AND <br />DECLARING AN EXTRAORDINARY EMERGENCY <br />The Ordinance was given first reading by title and second reading in full. Councilman Hahn made a motion that the <br />Ordinance be referred to the Ordinance Committee for further study. Councilman Carr seconded the motion. Motion <br />carried. <br />ORDINANCE <br />AN ORDINA= ANENDING SECTION 5.OF ORDINANCE`NO.,3743'ADOPTED APRIL 25, 1950, <br />WHICH SAID ORDINANCE TITLE READS"AS'FOLLOWS; AN ORDINANCE PROVIDING FOR:.THE; <br />ESTABLISHMENT OF A BUREAU OF FIRE PREVENTION, PROVIDING OFFICERS THEREFOR AND <br />DEFINING THEIR POWERS AND DUTIES, PRESCRIBING REGULATIONS FOR FM PREVENTION <br />AND LIFE SAFETY, AND PRESCRIBING RENAlTIESFOR "THE VIOLATION ;'01` .ITS PROVISIONS <br />The Ordinance was given first reading by title-and second reading in full, Councilman Kroll made a motion that the <br />Ordinance be referred to the Ordinance Committee for further study. Councilman Carr seconded the motion. Motion <br />carried. <br />OLD BUSINESS <br />Councilman Muszynski announced that Railroad ;Grader<crossings in several parts of the City are in deplorable con- <br />dition despite the letter received from the Board of Public Works and Safety at the last regular meeting of the <br />Council stating the conditions to be corrected, <br />The Clerk was directed to refer the matter to the Board of Public Works and Safety with a recommendation that a <br />stronger letter be written to the Railroads demanding that the Railroads obey their contracts with the City which <br />include the maintenance of all grade crossings. <br />Councilman Kroll informed the Council that when a portion of Johnson Street was vacated, the Chicagg South Shore and <br />South Bend Railroad promised to move their signals from Johnson Street to Brookfield Street. To date the signals <br />have not been moved. The Clerk was directed to ask the Board of Public Works and Safety to remind the C.S.S.& SB, RR <br />of this matter and have it corrected. <br />
