REPORT OF CITY PLANNING COMMISSION: <br />The Honorable Common Council March 7, 1958 <br />City of South Bend <br />South Bend, Indiana <br />Gentlemen: <br />The attached petition of Michael Ettl, et al, to zone from "B" Residential Use to "C" Commercial Use and "D" Height <br />and Area District lots numbered 25 -32, inclusive, of the Oakside 2nd Addition being on the west side of Michigan <br />Street between Eckman and Oakside Streets was legally advertised on 24 February 1958 and given public hearing under <br />date of 6 March 1958. The following action was taken: <br />RLH /mah <br />Attach. <br />After due consideration the Commission found that the commercial zoning of subject property <br />would extent undesirable strip zoning thus creating more traffic conflict, that there existed <br />in the immediate vicinity ample commercially zoned land on either side of Michigan Street that <br />was not now used commercially, and that substantial justice would be done by the unfavorable <br />recommendation of the petition. <br />It was therefore moved, seconded and unanimously carried that the petition be recommended <br />unfavorably to the Common Council. <br />Very truly yours, <br />CITY PLANNING COMMISSION <br />/s/ Robert L. Motion carried. <br />REPORT OF CITY PLANNING COMMISSION: <br />The Honorable Common Council <br />City of South Bend <br />South Bend, Indiana <br />Gentlemen: <br />8 March 1958 <br />We hereby petition your Honorable body to take appropriate action to amend Ordinance #3702 by the adoption of the <br />attached ordinance relative to off - street parking and loading requirements. <br />The attached ordinance amending Ordinance #3702 was legally advertised on 26 August 1957 and given public hearing <br />under date of 5 September 1957. The following action was taken: <br />After due consideration the Commission found that substantial justice would be done <br />by the favorable recommendation of the ordinance. Motion carried. <br />ORDINANCES, FIRST AND SECOND READING: <br />ORDINANCE <br />AN ORDINANCE ANNEXING LANDS TO AND DECLARING SAME <br />TO BE A PART OF THE CITY OF SOUTH BEND, INDIANA <br />(195.1 acres Hepler Street -- -Clay Township) <br />The Ordinance was given first reading by title and second reading in full. Councilman Hahn made a motion that the <br />Ordinance be set for Public Hearing on March 24, 1958. Councilman Kroll seconded the motion. Motion carried. <br />ORDINANCE <br />ORDINANCE ANNEXING LANDS TO AND DECLARING SAME TO <br />BE A PART OF THE CITY OF SOUTH BEND, INDIANA <br />(1.4 acres Rose Street - -Clay Township) <br />The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that <br />the Ordinance be set for public hearing on March 24, 1958. Councilman Kroll seconded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING <br />ORDINANCE NO. 3702 (Portage Avenue -- Leland and Pierce) <br />The Ordinance was given first reading by title and second reading in full. Councilman Christman made a motion that <br />the Ordinance be stricken from the record. Councilman Erler seconded the motion. Motion carried by a roll call vot <br />of 9 ayes, 0 nays. <br />AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY <br />KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH <br />BEND, INDIANA. (REAL ESTATE INVOLVED LOCATED ON <br />THE WEST SIDE OF SOUTH MICHIGAN STREET BETWEEN: <br />ECKMAN STREET AND OAKSIDE STREET) <br />The Ordinance was given first reading by title and second reading in full. Gouncilman Kroll,.made a- motion that the <br />Ordinance be set for Public Hearing on March 24, 1958. Councilman Muszynski seconded the motion. Motion carried. <br />
