COMMITTEE OF THE WHOLE MEETING MAY 10, 1971 <br />COMMITTEE OF THE WHOLE MEETING <br />ORDINANCE <br />AN ORDINANCE AMENDING THE MUNICIPAL CODE <br />OF THE CITY OF SOUTH BEND, INDIANA -1962 <br />SECTION 40 AS AMENDED AND GENERAL ORD- <br />INANCE NO. 4990 -68, AND THE ACCOMPANYING <br />MAP THERETO, GENERALLY KNOWN AS THE SOUTH <br />BEND ZONING ORDINANCE BY CHANGING THE <br />CLASSIFICATION OF THE USE DISTRICT FOR A <br />CERTAIN PARCEL OF LAND. <br />(Lot #2, Pleasant View Manor) <br />This being the time heretofore set for public hearing on the above ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Mr. Douglas Carpenter, Senior Planner <br />of the Area Plan Commission, explained that this lot had been omitted when its surrounding area, <br />recently annexed, was zoned residential. He said the Area Plan Commission was asking that this <br />be zoned to single family residential as the surrounding area is now zoned. <br />Councilman. Palmer made a motion, seconded by Councilman Craven, that the ordinance go to the <br />Council as favorable. Motion carried. 8 ayes, 0 nays, 1 absent (Councilman Szymkowiak). <br />ORDINANCE <br />AN ORDINANCE AMENDING AND SUPPLEMENTING <br />ORDINANCE NO. 4990 -68 CHAPTER 40 OF THE <br />MUNICIPAL CODE OF THE CITY OF SOUTH BEND, <br />INDIANA, FORMERLY REFERRED TO AS ZONING <br />ORDINANCE NO. 3702. <br />(Portage & Maple Roads) <br />This being the time heretofore set for public hearing on the above ordinance, proponents and <br />opponents.were given an opportunity to be heard thereon. Mr. Joseph Roper, Attorney -at -Law, <br />(representing the Grant Holladay Development Corporation, Fort Wayne, Indiana, stated that the <br />land had been zoned in November 1969 but that the firm had been unable to get financing and <br />start construction within a year as required. Therefore, he said the zoning reverted to single <br />family residential. The petitioner now is asking the Council to rezone the tract to "B" re- <br />sidential again and he said the firm is ready to begin construction immediately. A discrepancy <br />in the legal description in the petition was clarified by Mr. Douglas Carpenter, Senior Planner <br />of the Area.Plan Commission. (The clarification follows in the minutes of this meeting listed <br />under Reports from the Area Plan Commission and Citizens Requests - Miscellaneous Matters) Mr. <br />James Kelley, Grant - Holladay Construction Corporation, assured Councilman Grounds, in whose'- distri <br />tract is located, that two junior league baseball diamonds will be developed to replace the <br />existing two Chet Waggoner parks in the area. He agreed to send Councilman Grounds a copy of <br />the contract so the Chet Waggoner League could be assured of the agreement. Councilman Zielinski <br />made a motion, seconded by Councilman Craven, that the ordinance go to the Council as favorable. <br />Motion carried. 8 ayes, 0 nays, 1 absent (Councilman Szymkowiak). <br />There being no further <br />Grounds entertained a <br />seconded by Councilman <br />business to be considered before the Committee of the Whole, Chairman <br />motion to rise and report to the Council.
