REGULAR MEETING JANUARY 26, 1971 <br />REPORT FROM THE COMMITTEE ON MINUTES <br />To the Common Council of the City of South Bend: <br />Your Committee on the inspection and supervision of the minutes would respectfully report that <br />they have inspected the minutes of the January 11, 1971 meeting of the Council and found them <br />correct. Palmer <br />There being no objections, the report was accepted as read and placed on file. <br />PETITIONS <br />Petition to amend Zoninq Ordinance: <br />We, the undersigned do hereby respectfully make application and petition the Common Council of <br />the City of South Bend to amend the Zoning Ordinance of the City of South Bend, Indiana, as <br />hereinafter requested, and in support of this application, the following facts are shown. <br />1. The property sought to be rezoned is located at approximately 1617 North Bendix Drive, South <br />Bend, Indiana. This real estate is located on the West side of North Bendix Drive between <br />Elwood Avenue and Keller Street, and being approximately 425 feet South of Keller Street. <br />2. The property is owned by Louis Gruszynski and Pelagia Kaniewski with an option to purchase <br />by Charles H. Auger and James E. Plunkett, subject to the rezoning being granted. <br />3. A legal description of the property is as follows: Part of the Southeast Quarter (1/4) of <br />Section 33, Township 38 North, Range 2 East described as follows: Beginning at a point <br />40 feet West and 425 feet South of the Northeast corner of said Quarter Quarter Section <br />(which point is on the West line of Bendix Drive); thence South 160 feet; thence West 565 <br />feet, more or less, to the East line of the recorded Replat of Lincoln Plaza 2nd Addition; <br />thence North 160 feet to the Southwest corner of the property conveyed to Robert Blum Lodge <br />278 Independent Order of Odd Fellows, by a deed recorded October 22, 1970 in Deed Record <br />731 page 635 thence East along the South line of said Odd Fellows property 565 feet to the <br />place of beginning, in St: Joseph County, Indiana. <br />4. It is desired and requested that the foregoing property be rezoned: From "A" Residential <br />Use and "A" Height and Area District TO "C" Commercial Use and "A" Height and Area District. <br />5. It is proposed that the property will be put to the following use and the following building <br />will be constructed: One (1) Building of masonry construction, cement blocks on the sides <br />and brick front, approximately 80 feet by 200 feet. Building to be used for offices, <br />warehousing and wholesale display area for appliances, furniture, carpeting, kitchen cabinets, <br />T.V.s and radios. <br />6. Number of off street parking spaces to be provided. Black Top will be provided for Twenty <br />(20) parking spaces. There is sufficient land available for expansion of parking spaces, <br />if needed. <br />7. Attached is a copy of (a) an existing plot plan showing my property and other surrounding <br />properties; (b) names and addresses of all the individuals, firms or corporations owning <br />property within 300 feet of the property sought to be rezoned; (c) site development plan. <br />Louis Gruszynski <br />Pelagia Kaniewski <br />/s/ F. Jay Nimtz <br />Councilman Zielinski made a motion, seconded by Councilman Grounds, that the petition be referred <br />to the Area Plan Commission for study. Motion carried. <br />REPORTS OF THE COMMITTEE OF THE WHOLE <br />Council- President Laven entertained a motion to waive the reading of the Committee of the Whole <br />Reports. Councilman Allen so moved, seconded by Councilman Wise. Motion carried unanimously. <br />
