<br />EQUIPMENT ", IN THE FIRE DEPARTMENT BUDGET, ALL

<br />PERSONAL ", TO ACCOUNT Q -221, "ELECTRIC CURRENT ",
<br />IN THE FIRE DEPARTMENT BUDGET, ALL BEING WITHIN THE
<br />GENERAL FUND.
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and
<br />opponents were given an opportunity to be heard thereon. Assistant Fire Chief Richard Busfield
<br />explained this appropriation was to be used for electric services in the Fire Stations. At the
<br />present time, total amount in the account is $18.24 noted Councilman Craven. Councilman Laven
<br />made a motion, seconded by Councilman Zielinski, that the ordinance go to the Council as favorable,

<br />AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION IN
<br />THE AMOUNT OF $8,000.00 FROM ACCOUNT Q -11,
<br />"SERVICES PERSONAL ", TO ACCOUNT Q -726, "OTHER
<br />EQUIPMENT ", IN THE FIRE DEPARTMENT BUDGET, ALL
<br />BEING WITHIN THE GENERAL FUND.
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and
<br />opponents were given an opportunity to be heard thereon. Assistant Fire Chief Richard Busfield
<br />explained this appropriation is needed for hose and other equipment in order to up -date all of
<br />the Fire companies. He said some of the new equipment they have was burned (hose) in the recent
<br />Nu -way store fire, therefore it must be replaced. Councilman Szymkowiak made a motion, seconded
<br />by Councilman Craven, that the ordinance go to the Council as favorable. Motion carried. 9 ayes,
<br />0 nays, 0 absent.
<br />Council President Laven announced that #8 on the Agenda has been omitted from the Agenda.
<br />ORDINANCE
<br />AN ORDINANCE CREATING A DEPARTMENT OF ECONOMIC
<br />DEVELOPMENT TO PROVIDE FOR INSUSTRIAL EXPANSION.
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and
<br />opponents were given an opportunity to be heard thereon. Those speaking against the proposed
<br />ordinance were: Mr. Lee Ullery, 726 Diamond Ave. South Bend;Dr. L. L. Taylor, 1318 E. Wayne St.,
<br />North, South Bend, Indiana; Dr. Kenneth DeVoe, 52978 Highland Dr., South Bend; Mr. & Mrs.
<br />Fredrick Mutzl, 320 Parkovash Ave., South Bend; and Mr. Matthew Krizman, 24228 Indiana Rd. #23,
<br />South Bend, City Attorney S. J. Crumpacker assured the remonstrators that the ordinance, based
<br />on a state statute, does not permit personal property to be acquired through the power of eminent
<br />domain vested in government, even through the wording is in the ordinance. He said the people
<br />were taking parts of the act out of context and that the act must be read in reference to all
<br />other state acts. Councilman Laven said he was distressed when he hears people argue against
<br />progress. Councilmen Szymkowiak and Craven expressed strong support of the ordinance. Mr. Gordon
<br />E. Medlock, a representative of Bache & Co., investment firm, explained the significance of tax
<br />free municipal bonds and said they spur industrial development because industry does not have to
<br />spend its own funds for capital improvements. Mr. Paul Hass, 19879 Kingsway Court, South Bend,
<br />said he owned property in South Bend and that he favored the ordinance. Mr. Frank Pollack, 525
<br />South Sherdian St., South Bend stated that he hadlistenedto both sides and he was against the
<br />adoption of the ordinance.
<br />Councilman Allen moved for a recess. Councilman Reinke seconded the motion. Motion carried.

<br />The Council portion of the Committee of the Whole reconvened. Time: 9:55 p.m.
<br />Councilman Allen asked City Engineer Taylor what the budget costs of other cities were who have
<br />this act. Mr. Taylor stated no other city in Indiana has a budget for the commission. Councilman
<br />Grounds asked if the Council has the power to cancel the commission. City Attorney Crumpacker
<br />replied that it has the power to do so. Councilman Laven made a motion, seconded by Councilman
<br />Reinke, that the ordinance go to the Council as favorable. Motion carried. 8 ayes, 1 nay, 0 absen
