(REGULAR MEETING - RECONVENED <br />Be it remembered that the Common Council of the City of South Bend, Indiana, reconvened in the <br />Council Chambers in the County -City Building on Monday, September 28, 1970, at 8 :37 p.m. with <br />8 members present and 1 absent (Councilman Grounds). The meeting was called to order by Council <br />President Robert O. Laven, who presided. <br />REPORT FROM THE COMMITTEE ON MINUTES <br />To the Common Council of the City of South Bend: <br />Your Committee on the inspection and supervision of the minutes, would respectfully report that <br />they have inspected the minutes of September 14, 1970 meeting of the Council and found them <br />correct. Palmer <br />There being no objections, the report was accepted as read and placed on file. <br />(CITIZENS REQUESTS - MISCELLANEOUS MATTERS <br />Mrs. Lee E. Swan, 2022 S. Swygart St., South Bend, supported the Walnut Street residents who have <br />been trying to get the City to repair large chuckholes in the section from Prairie Avenue to" <br />Ewing Avenue. She submitted a hand drawn map to each Councilman showing Walnut St. as an arterial <br />that runs from Ewing to Lincoln Way West and said the residents should not be asked to pay a <br />portion of these repairs on Walnut Street. <br />Mrs. F. S. Wlodarski, 1869 Riverside Drive said she agreed with Mrs. Swan and stated that the <br />city has surfaced many streets that don't need it. She also registered a complaint and asked <br />that the Council investigate the disturbances on Sunday afternoons in the 1800 block of Riverside <br />Drive. Her complaint charged indecent behavior, drinking, foul language and tire squealing by <br />persons parking along the St. Joseph River. Council President Laven asked the Clerk to make a <br />note of the complaint and requested a communication be forwarded to the Board of Works & Safety. <br />Mrs. Fredrick Mutzl, 320 Parkovash, South Bend, commented on the action taken by Councilman Allen <br />for getting together a committee to study South Bend's trash problem. Councilman Allen is chair- <br />man'of the Public Improvements Committee. <br />REPORT FROM THE CITY CONTROLLER <br />The report from the City Controller James A. Bickel for the month of August, 1970 was deferred <br />until the meeting of October 13, 1970. Mr. Bickel was out of town and unavailable for comments. <br />REPORT FROM AREA PLAN COMMISSION <br />Mr. Robert Laven, President September 25, 1970 <br />South Bend Common Council ' <br />County -City Building <br />South Bend, Indiana 46601 <br />Dear Mr. Laven; <br />On August 18, 1970, the Area Plan Commission held a public hearing on the proposed ordinance <br />initiated by the Common Council being: An Ordinance amending Section 23 (c) of Ordinance 4990 -68, <br />being Section 40 -8 (c) of the Municipal Code, relating to action by the Common Council on unfavor- <br />able reports from the Area Plan Commission. <br />The Area Plan Commission, at its regular meeting on September 15, 1970, took the following action <br />on the subject ordinance: <br />Motion was made and seconded and unanimously passed that in view of the Commission's <br />opinion that they do not have the power to act on this particular ordinance and in- <br />stead of recommending the ordinance favorably or unfavorably, they provide the opinion <br />that it should require a three - fourths vote on the part of the Common Council to <br />override the Area Plan Commission on an unfavorable report and recommend that state <br />legislation be enacted to require a three - fourths vote to override an unfavorable <br />opinion from the Area Plan Commission. <br />HB :eb <br />There being no objections, the report <br />directed the Clerk to send a letter to <br />requesting that the ordinance referred <br />committee and set for public hearing. <br />Very truly yours, <br />/s/ Howard Bellinger, <br />Executive Director <br />was accepted and placed on file.
