REGULAR MEETING
<br />AUGUST 10, 1970
<br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council
<br />Chambers in the County -City Building on Monday, August 10, 1970 at 8:00 p.m., with all members
<br />present. The meeting was called to order by Council- President Robert 0. Laven. The invocation
<br />was given by Reverend Forest Howell, Grace United Methodist Church, 3012 S. Twyckenham Drive,
<br />South Bend, Indiana.
<br />ROLL CALL
<br />PRESENT: Councilmen Laven, Allen, Reinke, Craven, Grounds
<br />Szymkowiak, Wise, Palmer and Zielinski.
<br />ABSENT: None
<br />.Council President Laven entertained a motion to resolve the Council into the Committee of the
<br />Whole on the state of the City to consider the items listed on the agenda for the consideration
<br />of the Committee of the Whole. Councilman Allen so moved. Councilman Zielinski seconded the
<br />motion. Motion carried. Time: 8:03 p.m.
<br />COMMITTEE OF THE WHOLE MEETING
<br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee
<br />of the Whole in the Council Chambers of the County -City Building on Monday, August 10, 1970, at
<br />8:04 p.m., all members present. The meeting was called to order by Chairman William W. Grounds,
<br />who presided.
<br />ORDINANCE
<br />AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE CITY
<br />OF SOUTH BEND, IDENTIFIED AS ORDINANCE NO. 4990,
<br />ORDINANCE NO, 3702, AS AMENDED, TO THE EXTENT IT IS
<br />STILL EFFECTIVE, AND THE MUNICIPAL CODE OF SOUTH BEND,
<br />INDIANA, SECTIONS 40 -1 TO SECTIONS 40 -43, AS AMENDED,
<br />TO THE EXTENT IT IS STILL EFFECTIVE. (Intersection
<br />of Mayflower and Sample Streets, 5323, W. Sample St.)
<br />This being the time heretofore set for public hearing on the above Ordinance, proponents and
<br />opponents were given an opportunity to be heard thereon. Mr. Doug Carpenter, Senior Planner,
<br />Area Plan Commission, said this zoning would allow for the expansion of an existing gasoline
<br />station. Councilman Szymkowiak asked if junk cars would be parked there. Mr. Donald Blackman,
<br />attorney for the petitioner, and Councilman Zielinski assured Councilman Szymkowiak that the
<br />owner guaranteed junk cars would not be on the presises. Councilman Zielinski made a motion
<br />seconded by Councilman Craven, that the ordinance go to the Council as favorable. Motion carried.

<br />ORDINANCE
<br />AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE 4990 -
<br />CHAPTER 40 OF MUNICIPAL CODE (FORMERLY ZONING ORDINANCE
<br />3702) AS AMENDED. (Edison Rd. & South Bend Avenue,
<br />Notre Dame)
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and
<br />opponents were given an opportunity to be heard thereon. Mr. Doug Carpenter, Area Plan Commis-
<br />sion, introduced Mr. George Cressy, of the real estate firm of Cressy & Everett, 332 N. Ironwood
<br />South Bend, Indiana, who spoke for the petitioners, He stated that this parcel of land covered
<br />by this ordinance is owned by the University of Notre Dame. -He stated that this is part of the
<br />land to be used for an eleven -story motel and restaurant complex. He said that once the financ-
<br />ing is completed for the venture, the developers will petition the Council to have the county
<br />portion of the site annexed to the city. Mr. Herman Hundere, architect, also explained various
<br />details of the complex to the Councilmen. Councilman Wise made a motion for the adoption of
