COMMITTEE OF THE WHOLE MEETING APRIL 28, 1970 <br />REGULAR MEETING <br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council <br />Chambers in the County -City Building on Tuesday, April 28, 1970 at 8:00 p.m. The meeting was <br />called to order by Council President Robert 0. Laven. The invocation was given by Reverend <br />Herbert T. Tetzlaff, St. Peters United Church of Christ, 915 N. Ironwood Drive, South Bend, <br />Indiana. <br />R M.T. 0 A T.T. <br />PRESENT: Councilmen Laven, Allen, Reinke, Craven, Grounds, Szymkowiak, <br />Palmer and Zielinski <br />ABSENT: Wise <br />Council President Laven entertained a motion to resolve the Council into the Committee of the <br />Whole on the state of the City to consider the items listed on the agenda for the consideration <br />of the Committee of the Whole. Councilman Allen so moved and Councilman Grounds seconded the <br />motion. Motion carried. Time: 8:02 p.m. <br />COMMITTEE OF THE WHOLE MEETING <br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee <br />of the Whole in the Council Chambers of the County -City Building on Tuesday, April 28, 1970, at <br />8:03 p.m. with eight members present, one member absent (Councilman Wise). The meeting was <br />called to order by Chairman William Grounds, who presided. <br />%i -s i Mixi mal <br />AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE NO. <br />4990 - CHAPTER 40 OF THE MUNICIPAL CODE (formerly <br />Zoning Ordinance No. 3702). (.42 acres of land <br />located near Northwest Corner of the Intersection of <br />McKinley Avenue and Hickory Road) (3533 E. McKinley) <br />This being the time heretofore set for public hearing on the above ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Mr. Joseph Helling, attorney for the <br />petitioner was unable to attend the meeting because of a conflict of interests. Mr. Doug <br />Carpenter, Senior Planner, Area Plan Commission answered various questions presented by the <br />Councilmen. He stated the tract was zoned to commercial for use as a real estate office. He <br />stated trucks will not be parked in the parking area, only real estate men and their clients will <br />use the lot. Councilman Szymkowiak made a motion, seconded by Councilman Reinke, that the <br />Ordinance go to the Council as favorable. Motion carried. <br />ORDINANCE <br />AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE <br />CITY OF SOUTH BEND, IDENTIFIED AS ORDINANCE NO. 4990, <br />ORDINANCE NO. 3702, AS AMENDED, TO THE EXTENT IT IS <br />STILL EFFECTIVE, AND THE MUNICIPAL CODE OF SOUTH BEND <br />INDIANA, SECTIONS 40 -1 TO SECTIONS 40 -43, AS AMENDED <br />TO THE EXTENT IT IS STILL EFFECTIVE (3000 E. McKinley <br />Avenue, Park Jefferson Apartments) <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Attorney Doug Seeley, representing the <br />petitioners, explained the proposed building will be used as a storage and utility space. He <br />stated that this was the final phase of the Park Jefferson development. Councilman Zielinski <br />made a motion, seconded by Councilman Craven, that the Ordinance go to the Council as favorable. <br />Motion carried. <br />nPnTNAMrR <br />AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE CITY <br />OF SOUTH BEND, IDENTIFIED AS ORDINANCE NO. 4990, <br />ORDINANCE NO. 3702, AS AMENDED, TO THE EXTENT IT IS <br />STILL EFFECTIVE, AND THE MUNICIPAL CODE OF SOUTH BEND, <br />INDIANA, SECTIONS 40 - 1 TO SECTIONS 40 -43, AS AMENDED, <br />TO THE EXTENT IT IS STILL EFFECTIVE. (150 W. Angela <br />Blvd.) <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Attorney Doug Seeley, representing <br />the petitioners, stated that there will be no exterior changes in the existing building, and <br />it will have the appearance of residential property. Mr. Max W. Jena, 913 Lawndale Avenue, <br />South Bend, asked where the entrance will be located. Mr. Seeley stated the entrance was placed <br />on Osego Drive. There was too great a traffic hazard to locate the entrance and exit drives on <br />Angela Blvd, he explained. Councilman Reinke made a motion, seconded by Councilman Palmer, that <br />the Ordinance go to the Council as favorable. Motion carried. <br />Council Chairman Grounds entertained a motion t< <br />Civic Auditorium for a portion of the meeting. <br />man Zielinski. Motion carried.
