<br />AN ORDINANCE APPROVING A CONTRACT BETWEEN THE
<br />WATER WORKS OF SOUTH BEND, INDIANA AND GENERAL
<br />EQUIPMENT & MACHINE COMPANY, INCORPORATED OF
<br />SOUTH BEND, INDIANA, FOR THE PURCHASE OF A 1970
<br />GENERAL ENGINES EAGER BEAVER TRAILER IN THE
<br />AMOUNT OF $2,870.00.

<br />The Ordinance was given first reading by title and second reading in full. Councilman Grounds
<br />made a motion the Ordinance be set for Public Hearing on January 26, 1970. Councilman Zielinski
<br />seconded the motion. Motion carried.
<br />ORDINANCE
<br />AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE
<br />CITY OF SOUTH BEND, IDENTIFIED AS ORDINANCE NO.
<br />4990, ORDINANCE NO. 3702, AS AMENDED, TO THE EXTENT
<br />IT IS STILL EFFECTIVE,AND THE MUNICIPAL CODE OF
<br />SOUTH BEND, INDIANA, SECTIONS 40 -1 TO SECTIONS 40 -43,
<br />AS AMENDED, TO THE EXTENT IT IS STILL EFFECTIVE.

<br />The Ordinance was given first reading by title and second reading in full. Councilman Reinke
<br />made a motion the Ordinance be set for Public Hearing on January 26, 1970. Councilman
<br />Szymkowiak seconded the motion. Motion carried.
<br />RESOLUTIONS
<br />RESOLUTION NO. 233 -70
<br />A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF
<br />SOUTH BEND, INDIANA, AUTHORIZING ENTRY INTO AN
<br />AGREEMENT FOR COOPERATIVE OPERATION OF A MICHIANA
<br />AREA COUNCIL OF GOVERNMENTS.
<br />WHEREAS, the Interlocal Cooperation Act, being Acts of 1957 of the Indiana General
<br />Assembly, Chapter 118 (more commonly known as Sections 53 -1101 to 53 -1107, Burns Indiana Statutes
<br />annotated, 1964 replacement) and Urban Cooperation Act No. 7, Michigan Public Acts of 1967,
<br />Extra Session, provides that public agencies may enter into an agreement with one another for
<br />joint and cooperative action; and
<br />WHEREAS, to insure that such joint, cooperative action and comprehensive planning
<br />processes are conducted in a framework of consistent policies, that the program is executed in
<br />accordance with sound management principles and is responsive and meets the needs of the
<br />regional area, and
<br />WHEREAS, the concept of voluntary cooperation among local governments, while retaining
<br />local home rule, is the best solution for dealing with regional challenges beyond individual
<br />capabilities; and
<br />WHEREAS, it is desirable, advantageous and in the public interest that the Civil
<br />City of South Bend, Indiana enter into an agreement for joint and cooperation action.
<br />NOW, THEREFORE, BE IT RESOLVED that the Civil City of South Bend, Indiana, hereby
<br />elects to enter into such agreement and to become a member of the Michiana Area Council of
<br />Governments.
<br />BE IT FURTHER RESOLVED, that the Mayor of the Civil City of South Bend, Indiana, be
<br />and he is hereby authorized and directed to execute said agreement.
<br />THIS RESOLUTION ADOPTED BY THE Common Council of the Civil City of South Bend, Indiana
<br />this 12th day of January, 1970.

<br />A public hearing was held at this time on the above resolution. Speaking in favor of adopting
<br />the resolution was Mayor Lloyd M. Allen. He stated that if South Bend joins the 5- county
<br />Michiana Area Council of Governments the City will be eligible to receive various federal
<br />assistance grants that have been denied in the past, for example; federal funds for the bus
<br />system and sewage plant expansion. He answered various other questions of the Councilmen.
<br />Councilman Reinke made a motion that the resolution be adopted. Councilman Szymkowiak seconded
<br />the motion. Motion carried. 9 ayes, (Councilmen Laven, Allen, Craven, Reinke, Grounds,
<br />Szymkowiak, Wise, Palmer and Zielinski). 0 nays.
