REGULAR MEETING <br />NOVEMBER 10, 1969 <br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council <br />Chambers in the City Hall on Monday, November 10, 1969 at 8:05 p.m._, with all members present <br />The meeting was called to order by Council President Robert 0. Laven. The invocation was given <br />by Reverend Carl Lemna, United Methodist Church, South Bend, Indiana. <br />ROLL CALL <br />PRESENT Councilmen Laven, Craven, Allen, Reinke, Grounds <br />Szymkowiak, Wise, Palmer and 'Zielinski. <br />ABSENT None. <br />Council President Laven entertained a motion to resolve the Council into the Committee of the <br />Whole on the state of the City to consider the items listed on the agenda for the consideration <br />of the Committee of the Whole. Council President Laven asked Councilman Grounds to chair the <br />Committee of the Whole meeting. <br />COMMITTEE OF THE WHOLE MEETING <br />Be it remembered that the Common Council of the City of South Bend, Indiana met in the Committee <br />of the Whole in the Council Chambers of City Hall on Monday, November 10, 1969 at 8:05 p.m., <br />with all members present. The meeting was called to order by Chairman William W. Grounds who <br />presided. <br />nPnTMAWrR <br />AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION FROM THE <br />GENERAL FUND IN THE AMOUNT OF $10,000.00 TO ACCOUNT <br />B -53 "REFUNDS, AWARDS AND INDEMNITIES" IN THE OFFICE. <br />OF THE CITY CONTROLLER. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. City Attorney S. J. Crumpacker explain <br />the reason for the appropriation. Claims carried over from 1968,not paid in that year due to <br />lack of funds, were paid out of this years appropriation, thus, leaving a shortage of funds for <br />this year. He also stated that there are several cases on the agenda of the Legal Department <br />which, when collected, will far exceed the amount requested in the Ordinance. He said the <br />amount collected this year and deposited in the General Fund far exceeds the amount paid out. <br />Councilman Szymkowiak made a motion that the Ordinance go to the Council as favorable. Council- <br />man Zielinski seconded the motion. Motion Carried. <br />ORDINANCE <br />AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE <br />CITY OF SOUTH BEND, INDIANA, IDENTIFIED AS ORDINANCE <br />NO. 4990, ORDINANCE NO. 3702, AS AMENDED, TO THE <br />EXTENT IT IS STILL EFFECTIVE, AND THE MUNICIPAL CODE <br />OF SOUTH BEND, INDIANA, SECTIONS 40 -1 to SECTIONS <br />40 - 43, AS AMENDED TO THE EXTENT IT IS STILL EFFEC- <br />TIVE. (Location: Western, Lombardy and,Villageway <br />Streets) <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Attorney G. Burt Ford, spoke in behalf <br />of Colpaert Realty Corp., owner involved in the petition to amend this zoning Ordinance. <br />He said Colpaert wants to rezone the land to Commercial for the construction of a Lou Ann Super- <br />market. He promised the entire 11 -acre tract will be developed if the petition is granted. <br />Mr. Anthony Panzica, architect, said a 6 -foot chain link (cannot be seen through) fence will be <br />erected between the Faith LutherEn Church and the market. Councilman Zielinski made a motion <br />that the Ordinance go to the Council as favorable. Councilman Craven seconded the motion. Moti <br />carried. <br />
