REGULAR MEETING NOVEMBER 10, 1969 Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Council Chambers in the City Hall on Monday, November 10, 1969 at 8:05 p.m._, with all members present The meeting was called to order by Council President Robert 0. Laven. The invocation was given by Reverend Carl Lemna, United Methodist Church, South Bend, Indiana. ROLL CALL PRESENT Councilmen Laven, Craven, Allen, Reinke, Grounds Szymkowiak, Wise, Palmer and 'Zielinski. ABSENT None. Council President Laven entertained a motion to resolve the Council into the Committee of the Whole on the state of the City to consider the items listed on the agenda for the consideration of the Committee of the Whole. Council President Laven asked Councilman Grounds to chair the Committee of the Whole meeting. COMMITTEE OF THE WHOLE MEETING Be it remembered that the Common Council of the City of South Bend, Indiana met in the Committee of the Whole in the Council Chambers of City Hall on Monday, November 10, 1969 at 8:05 p.m., with all members present. The meeting was called to order by Chairman William W. Grounds who presided. nPnTMAWrR AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION FROM THE GENERAL FUND IN THE AMOUNT OF $10,000.00 TO ACCOUNT B -53 "REFUNDS, AWARDS AND INDEMNITIES" IN THE OFFICE. OF THE CITY CONTROLLER. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. City Attorney S. J. Crumpacker explain the reason for the appropriation. Claims carried over from 1968,not paid in that year due to lack of funds, were paid out of this years appropriation, thus, leaving a shortage of funds for this year. He also stated that there are several cases on the agenda of the Legal Department which, when collected, will far exceed the amount requested in the Ordinance. He said the amount collected this year and deposited in the General Fund far exceeds the amount paid out. Councilman Szymkowiak made a motion that the Ordinance go to the Council as favorable. Council- man Zielinski seconded the motion. Motion Carried. ORDINANCE AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, IDENTIFIED AS ORDINANCE NO. 4990, ORDINANCE NO. 3702, AS AMENDED, TO THE EXTENT IT IS STILL EFFECTIVE, AND THE MUNICIPAL CODE OF SOUTH BEND, INDIANA, SECTIONS 40 -1 to SECTIONS 40 - 43, AS AMENDED TO THE EXTENT IT IS STILL EFFEC- TIVE. (Location: Western, Lombardy and,Villageway Streets) This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Attorney G. Burt Ford, spoke in behalf of Colpaert Realty Corp., owner involved in the petition to amend this zoning Ordinance. He said Colpaert wants to rezone the land to Commercial for the construction of a Lou Ann Super- market. He promised the entire 11 -acre tract will be developed if the petition is granted. Mr. Anthony Panzica, architect, said a 6 -foot chain link (cannot be seen through) fence will be erected between the Faith LutherEn Church and the market. Councilman Zielinski made a motion that the Ordinance go to the Council as favorable. Councilman Craven seconded the motion. Moti carried.
