V-% <br />COMMITTEE OF THE WHOLE MEETING OCTOBER 13, 1969 <br />�OIvhVIITTEE OF THE WHOLE TWEETING <br />OCTOBER 13, 1969 <br />3e it remembered that the Common Council of the City of South Bend, Indiana met in the Committee <br />Df the Whole in the Council Chambers of City Hall. on Monday, October 13, 1969, at 8:00 p.m., all <br />nembers being present. The invocation was given by Reverend Birt Harris, Good Shepherd Church, <br />South Bend, Indiana. The meeting was called to order by Chairman William W. Grounds. <br />DRDINANCE <br />AN ORDINANCE REGULATING THE BURNING OF REFUSE AND <br />PROVIDING PENALTIES FOR THE VIOLATION THEREOF. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents titi'ere given an opportunity to be heard thereon. Councilmen Szymkowiak and Craven explain <br />ed the purpose of the ordinance would ban the burning of garbage and other materials that cause <br />noxious odors. Mr. MCKean,_;Cleveland Road, South Bend, asked if the Ordinance covered the burning <br />that was taking place on Cleveland. Mr. Taylor, City Engineer reel ed that burning will stop <br />next week at that site, however all this material vaill be burned at rumstown dump in the future. <br />Mr. Roman J. Kowalski, 802 Birchwood St. asked about people who owned commercially -sold indoor <br />incinerators for burning garbage. City Attorney S.J. Crumpacker said this Ordinance applied to <br />all garbage burning. Councilman Allen stated the Ordinance was specifically for eliminating out- <br />door garbage burning in trash cans. <br />Councilman Allen made a motion that the Ordinance be re- committed to the Ordinance Committee for f, <br />study. Councilman Laven seconded the motion. Motion carried. <br />Councilman Laven proposed an amendment to Councilman Allen's motion that the Ordinance be brought <br />out of committee on November 10, 1969. Councilman Craven seconded the motion. motion carried. <br />Councilman Laven made a motion that the Ordinance be re- committed to the Ordinance Committee for <br />further study and reported out of the Committee on November 10, 1969. Councilman Craven seconded <br />the motion. Motion carried. 7 ayes. (Councilman Laven, Craven, Allen, Grounds, Palmer, Wise <br />and Zielinski. 2 nays. (Councilmen Reinke and Szymkowiak) <br />ORDINANCE <br />AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION TO <br />ACCOUNT L -323, "TIRES AND TUBES" IN THE AMOUNT <br />OF $150.00 AND THE TRANSFER OF SAID SUM FROM <br />ACCOUNT L -722, "MOTOR EQUIPIVENT ", IN THE ENGINE- <br />ERING DEPARTMENT, ALL BEING WITHIN THE GENERAL <br />FUND. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />,opponents were given an opportunity to be heard thereon. City Engineer Lloyd Taylor explained <br />that the appropriation was for tires for the seven cars in the Engineering Department. <br />Councilman Allen made a motion that the Ordinance go to the Council as favorable. Councilman <br />Zielinski seconded the motion. Motion carried. <br />LORDINANCE <br />AN ORDINANCE APPROPRIATING $2,000.00 FROM THE <br />GENERAL FUND TO ACCOUNT B -242, "PUBLICATION OF <br />LEGAL NOTICES ", IN THE OFFICE OF CITY CONTROLLER. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. City Controller James A. Bickel stated <br />that this amount will carry the account through the end of the year. Councilman Reinke made a <br />motion that the Ordinance go to the Council as favorable. Councilman Craven seconded the motion. <br />Motion carried. <br />ORDINANCE <br />AN ORDINANCE ANNEXING TERRITORY TO THE MUNICIPAL <br />CITY OF SOUTH BEND, INDIANA, WHICH IS COMMONLY <br />DESCRIBED AS WHITCOMB & KELLER "S APARTMENT COMPLEX. <br />(St. Joseph River & Angela Blvd. Bridge) <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Mr. Hostetler, South Bend, asked if <br />the City was planningto annex additional land near the Whitcomb & Keller Complex. City Engineer <br />Lloyd Taylor replied "No ". Councilman Wise made a motion that the Ordinance go to the Council as <br />favorable. Councilman Szymkowiak seconded the motion. Motion carried. <br />ther <br />
