COMMITTEE OF THE WHOLE MEETING <br />COMMITTEE OF THE WHOLE MEETING <br />JULY 28, 1969 <br />F Waf <br />Lad--.W, : <br />Be it remembered that the Common Council of the City of South Bend, Indiana met in the Committee <br />of the Whole in the Council Chambers of City Hall on Monday, July 28, 1969, at 8:20 p.m., with <br />nine members present, none absent. The invocation was given by Reverend Bernard L. White, <br />St. John Baptist Church, South Bend, Indiana. The meeting was called to order by Chairman <br />William W. Grounds, who presided. <br />ORDINANCE <br />AN ORDINANCE APPROPRIATING THE SUM OF $39,400.00 FROM THE <br />CUMULATIVE BUILDING AND SINKING SEWER FUND FOR ENGINEERING <br />SERVICES. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Andrew A. Toth, 311 S. Eddy, explained <br />his plan for solving the problem of storm water drainage in the City. His plan was submitted <br />to the City Engineer, Lloyd Taylor and he replied that the plan was being considered. Councilman <br />Allen made a motion that the Ordinance be amended to read in the title, second paragraph of <br />Section I, - CUMULATIVE SEWER BUILDING AND SINKING FUND - . Councilman Zielinski seconded the <br />motion. Motion Carried. Councilman Reinke made a motion that the Ordinance go to the Council <br />as favorable, as amended. Councilman Craven seconded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS FROM THE <br />GENERAL FUND IN THE AMOUNT OF $1,654.00 TO ACCOUNT <br />C -11, "SERVICES PERSONAL" AND IN THE AMOUNT OF $286.00 <br />TO ACCOUNT C -213, "TRAVELING EXPENSES ", IN THE OFFICE <br />OF THE CITY CLERK AND ALL BEING WITHIN THE GENERAL FUND. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Inquiries were made by Miss Virginia <br />Guthrie, Executive Secretary of the Civic Planning Assoc. as to the reasons more help was needed <br />in the Clerk's Office. Mrs. Blough stated that an increase in Court work necessitates the <br />additional clerk. Councilman Reinke agreed that the Clerk should attend the meeting of the <br />Municipal Clerks in New York because she is an officer of the Organization. Councilman Reinke <br />made a motion that the Ordinance go to the Council as favorable. Councilman Szymkowiak seconded <br />the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE CREATING A "JUNK VEHICLE FUND" AND <br />DENOMINATING THE BOARD OF PUBLIC WORKS AND SAFETY <br />AS THE DEPARTMENT OF CITY GOVERNMENT RESPONSIBLE <br />FOR THE REMOVAL, STORAGE AND DISPOSAL OF ABANDONED <br />VEHICLES ACCORDING TO THE ABANDONED VEHICLE ACT <br />ENACTED BY THE 1969 INDIANA GENERAL ASSEMBLY. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Mr. Lloyd Taylor, City Engineer, and <br />City Attorney S. J. Crumpacker, explained the Junk Vehicle Ordinance Fund. They explained <br />that this Ordinance would create a junk vehicle fund and authorize the city to dispose of the <br />junk cars under a state enabling statute. Owners would be assessed a fee, if they can be found, <br />for the removal of the cars. The police chief would designate a special policeman to conduct the <br />program. Councilman Laven made a motion that the Ordinance be amended to read as follows: <br />"Section III. Whenever the term "officer" is used in the Abandoned Vehicle Act. the Chief of <br />Police of the City of South Bend, Indiana, is hereby empowered to delegate such duties and powers <br />as are conferred by said Act upon such officer to special police officers appointed by the Board <br />of Public Works and Safety pursuant to statute." The present Section III is changed to read <br />"Section IV." .Councilman Craven seconded the motion. Motion carried. Councilman Wise made a <br />motion that the Ordinance go to the Council favorable, as amended. Councilman Laven seconded <br />the motion. 8 ayes (Councilmen Laven, Craven, Wise, Grounds, Zielinski, Reinke, Palmer and <br />Szymkowiak. 1 nay, (Councilman Allen). <br />ORDINANCE <br />AN ORDINANCE FURTHER AMENDING ORDINANCE NO. 3232, AS <br />AMENDED, COMMONLY KNOWN AS THE COUNCILMANIC DISTRICT <br />ORDINANCE, BEING SECTION 12 OF CHAPTER 1 OF THE <br />MUNICIPAL CODE OF THE CITY OF SOUTH BEND. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Councilman Laven outlined the salient <br />points of the redistricting ordinance and said it was conceived with the aid of the University <br />of Notre Dame Professors and Computer Center. Councilman Reinke made a motion that the Ordinance <br />be recommended to the Council as favorable. Councilman Laven seconded the motion. Motion carried <br />7 ayes, (Councilmen Laven, Craven, Wise, Grounds, Reinke, Allen and Palmer.) 2 nays, Councilmen <br />Zielinski and Szymkowiak. <br />ORDINANCE <br />AN ORDINANCE AMENDING ORDINANCE NO. 3232, ADOPTED BY THE <br />COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, THERE- <br />AFTER AMENDED AND AS ADOPTED AND CODIFIED OCTOBER 14, 1963, <br />COMMONLY KNOWN AS THE COUNCILMANIC DISTRICT ORDINANCE OF <br />THE CITY OF SOUTH BEND. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon.
