COMMITTEE OF THE WHOLE <br />COMMITTEE OF THE WHOLE MEETING <br />APRIL 14, 1969 <br />4-65 <br />Be it remembered that the Common Council of the City of South Bend, Indiana met in the Committee <br />of the Whole in the Council Chambers of City Hall on Monday, April 14, 1969 at 8:00 p.m., <br />with all members present. The Invocation was given by Reverend Matt Kafka, St. Ada.lbert Church, <br />South Olive Street, South Bend, Indiana. The meeting was called to order by Chairman William <br />W. Grounds. <br />ORDINANCE <br />AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF SOUTH <br />BEND, INDIANA - 1962, SECTION 40 AS AMENDED AND GENERAL <br />ORDINANCE N0. 4990 -68, AND THE ACCOMPANYING MAP THERETO, <br />GENERALLY KNOWN AS THE SOUTH BEND ZONING ORDINANCE BY CHANGING <br />THE CLASSIFICATION OF THE USE DISTRICT FOR A CERTAIN PARCEL OF <br />LAND. (INTERSECTION MAPLE & DOUGLAS ROADS) <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Council President Laven explained <br />to Miss Virginia Guthrie, South Bend Civic Planning Association, that this area was east of <br />Maple Road and it was the only tract (5- acres) of the Hartman sub - division without residential <br />buildings. He also stated the west side of Maple Road was under consideration for annexation. <br />Councilman Reinke made a motion that the Ordinance go to the Council as favorable. Councilman <br />Zielinski seconded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE 4990 (CHAPTER <br />40 OF MUNICIPAL CODE) OF THE CITY.OF SOUTH BEND, INDIANA <br />(ST. JOSEPH RIVER & ANGELA BLVD. BRIDGE) <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Attorney Joseph Helling, 224 W. Jef- <br />ferson Blvd., representing Whitcomb & Keller Builders (petitioners) said.the tract will be <br />developed along with a contiguous 27 acre tract immediately north along the river and which is <br />to be annexed to the city later. He explained the city is now receiving only $400.00 a year in <br />taxes on this property. There will be luxury-apartment houses erected on the site with lagoons <br />arda private entrance from a northward extension of North Shore Blvd. from Angela. Councilman <br />Szymkowiak asked about safety measures being taken around the lagoons - -Mr. Helling said signs <br />will probably be erected denoting no swimming or boating. He also stated measures were taken <br />for safetyyfire equipment will have a 40 ft. turning radius entry and exit. Councilman Laven ask <br />when the project will be completed and Mr. Helling replied "in about three years." Councilman <br />Szymkowiak made a motion that the Ordinance go to the Council as favorable. Councilman Reinke <br />seconded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS FROM THE GENERAL FUND IN <br />THE AMOUNT OF $475.00 TO ACCOUNT M- 252, "REPAIRS OF EQUIPMENT "IN THE <br />AMOUNT OF $375.00 AND TO ACCOUNT M -43, "REPAIR PARTS" IN THE AMOUNT <br />OF $100.00, IN THE BUILDING DEPARTMENT BUDGET AND ALL BEING WITHIN <br />THE GENERAL FUND. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Mr. Forrest West, Building Commis- <br />sioner spoke in favor of the Ordinance. Mr. West said his accounts for auto repair are just <br />about depleted as a result of flat tires and transmission repairs of the cars in his department. <br />Questioned by Miss Virginia Guthrie, South Bend Civic Association, and Councilman Allen, Mr. <br />West stated that additional funds are needed to carry him through the 1969 budget year. Miss <br />Guthrie said Mr. West was under - budgeting and suggested that funds be transferred from other <br />accounts in his budget instead of appropriating additional funds. Councilman Szymkowiak made a <br />motion that the Ordinance go to the Council as favorable. Councilman Craven seconded the motion. <br />Motion carried. 7 ayes (Councilmen Craven, Grounds Palmer, Reinke, Szymkowiak, Wise, Zielinski) <br />2 nays (Councilmen Allen, Laven) <br />ORDINANCE <br />AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS FROM THE GENERAL FUND <br />IN THE AMOUNT OF $3,500.00 TO ACCOUNT B -263 "OTHER CONTRACTUAL <br />SERVICES" IN THE AMOUNT OF $2,000.00 AND TO ACCOUNT B -363, "OTHER <br />OFFICE SUPPLIES" IN THE AMOUNT OF $1,500.00 IN THE OFFICE OF <br />CONTROLLER AND ALL BEING WITHIN THE GENERAL FUND. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Speaking in favor of the ordinance <br />was City Controller, James A. Bickel, who said space (storage) in the new building is limited <br />and many old records will have to be destroyed or given to the Northern Indiana Historical <br />Society Museum. He said microfilming will start with the minutes of the Board of Public Works <br />and Safety. Councilman Allen suggested that City Hall records be stored in City Hall, which <br />will be vacant after the move to the new complex, or in the ,museum building. Mr. Biclel stated <br />that City Hall will twt be maintained after its abandonment and that records must be kept in <br />the direct custody of city officials. Included in the same ordinance was $1500 for the purchase <br />of bicycle license tags which are renewable every three years and for which funds had not been <br />budgeted. Councilmen Craven and Allen stated they were reluctant to approve this ordinance. <br />Councilmen Palmer made a motion that the Ordinance go to the Council as favorable. Councilman <br />Szymkowiak seconded the motion. Motion carried. <br />At this time the Chair was taken by Councilman -at -Large Fred Craven. Councilman Grounds was <br />excused to be absent from the meeting for a short time, <br />
