SPECIAL MEETING OCTOBER 7, 1968 <br />Amended minutes as recommended by the Legal Department <br />SPECIAL MEETING <br />OCTOBER 7, 1968 <br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in Special Session pursuant to <br />call of Special Meeting in accordance with law in City Hall on Monday, October 7, 1968, at 8:20 P.M., in the <br />Council Chambers. The meeting was called to order by Robert 0. Laven, President. <br />ROLL CALL <br />PRESENT Councilmen, Laven, Allen, Craven, Reinke, Grounds, <br />Szymkowiak, Wise, Palmer, and Zielinski. <br />ABSENT None. <br />Robert 0. Laven, President, stated that the purpose of the Special Meeting was to conduct a pub9.ic hearing on a <br />proposed Cumulative Sewer Building and Sinking Fund Ordinance and that said hearing would be conducted by the <br />Committee of the Whole of the Council. <br />COMMITTEE OF THE WHOLE MEETING <br />William W. Grounds, Chairman of the Committee of the Whole, then called the committee to order and announced <br />that the Committee would conduct a public hearing on the following proposed ordinance, to -wit: <br />AN ORDINANCE TO CREATE A CUMULATIVE SEWER <br />BUILDING AND SINKING FUND TO BE KNOWN AND <br />DESIGNATED AS THE SEWAGE TREATMENT, STORM <br />SEWER AND DISPOSAL PLANT FUND, AND PROVIDING <br />FOR A TAX LEVY OF $.25 ANNUALLY FOR A PERIOD <br />OF TWELVE (12) YEARS, AS AMENDED. <br />Councilman Robert 0. Laven stated that it was the intent to levy taxes for the fund in 1968, payable in 1969, <br />and the proposed ordinance should be amended to reflect such intention and another public hearing be held. <br />Whereupon Councilman William W. Grounds stated that since this was a public hearing on the proposed ordinancce, <br />anyone present who wished to be heard could speak. No one spoke other than Virginia Guthrie, executive <br />secretary of the South Bend Civic Planning Association, who said she would withhold comment until the public <br />hearing on the proposed ordinance as amended. Whereupon Councilman Robert 0. Laven moved that the proposed <br />ordinance be amended as follows: <br />SECTION III. The entire section be deleted and the following <br />be substituted: <br />"There is hereby levied for each year commencing 1968, payable in <br />1969, and extending throught 1979, payable in 1980 a tax levy to <br />be paid into said fund of the sum of $.25 on each One Hundred <br />($100.00) Dollars of taxable property located within the said City <br />of South Bend, Indiana." <br />SECTION IV. On the second line, after the word "the ", delete <br />"7th" and insert 1121st ". <br />Councilman Wise seconded the motion. Motion carried. Councilman Laven made a motion the ordinance go to the <br />Council favorable as amended. Councilman Wise seconded the motion. Motion carried. Councilman Allen made <br />a motion to rise and report to the Council. Then Councilman Laven seconded the motion. Laven presiding. <br />Your Committee of the Whole to whom was referred "AN ORDINANCE TO CREATE A CUMULATIVE SEWER BUILDING AND <br />SINKING FUND TO BE KNOWN AND .DESIGNATED AS THE SEWAGE TREATMENT, STORM SEWER AND DISPOSAL PLANT FUND, AND <br />PROVIDING FOR A TAX LEVY OF $.25 ANNUALLY FOR A PERIOD OF TWELVE (12) YEARS, AS AMENDED ", respectfully re- <br />port that they have examined the matter and that in their opinion the amended ordinance be amended as follows: <br />SECTION III. The entire section be deleted and the following <br />be substituted: <br />"There is hereby levied for each year commencing 1968 payable in 1969, and <br />extending through 1979, payable in 1980 a tax levy to be paid into said <br />fund of the sum of $.25 on each One Hundred ($100.00) Dollars of taxable <br />property located within the said City of South Bend, Indiana." <br />SECTION IV. On the second line, after the word "the ", delete <br />"7th "-and insert "21st ". <br />There being no objection, the report was accepted as read. Councilman Wise moved the ordinance be amended as <br />follows: <br />SECTION III.
