COMMITTEE OF THE WHOLE MEETING <br />SEPTEMBER 9, 1968 <br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole <br />in the Council Chambers of City Hall on Monday, September 9, 1968, at 8:07 P.M., nine members present, (Council- <br />men Laven, Allen, Craven, Reinke, Grounds, Szymkowiak, Wise, Palmer, and Zielinski). None absent. The invo- <br />cation was given by Reverend Kenneth Dallagher, Calvary Temple. The meeting was called to order by Chairman <br />William W. Grounds, who presided. <br />ORDINANCE <br />AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE 4990 <br />(CHAPTER 40 MUNICIPAL CODE) OF THE CITY OF SOUTH BEND, <br />INDIANA. North Side Ireland Road between Ireland Road <br />and Walter St. (Ayr -Way) <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were <br />given an opportunity to be heard thereon. Speaking in favor of the Ordinance was Mr. John K. Wilson, executive <br />director of the Area Plan Commission, which has made a favorable recommendation for the rezoning. He explained <br />that an extensive study had been made of the area and that a great deal of land use in this area is commercial <br />zoning. City Engineer, Lloyd S. Taylor, explained the solution to the traffic problem that would be created. <br />by the rezoning. Repretentng'the petitioners_-was.Attorney Joseph T. Helling, who stated the necessary <br />changes recommended by the Area Plan Commission had been made in the Plot Plan. Speaking against the Ordinance <br />was Attorney F. G. Feeney, representing the remonstrators. Mr. Feeney presented the following exhibits: <br />Exhibit I - Remonstrance Petition with 99 property owners signatures; Exhibit II - Signatures of 153 parents <br />of children attending John O'Brien Elementary School; Exhibit III - Minutes of July 29, 1929 Board of Commissio <br />meeting; Exhibit IV - Minutes of May 13, 1929 Board of Commissioners meeting; Exhibit V - Minutes of March 10, <br />1930 Board of Commissioners meeting; Exhibit VI - Letter from Jerome T. Ewald, St. Joseph County Surveyor, <br />and Exhibit VII - photographs of homes located in area to be rezoned. Others speaking against the Ordinance <br />were Colonel H. J. Abraham, 4328 S. Fellows St, Mrs. Albert Sipotz, 202 E. Walter, Mr. Russell T. Cecil, <br />4302 Fellows, Mr. Oscar J. VanWooley, 4321 S. Fellow, Mr. Joseph B. Dosmann, 4312 Fellows, and Mr. H. Clifford <br />Rich- 4412 S. Fellow Street. Councilman Szymkowiak made a motion for a ten minute recess. Councilman <br />Laven seconded the motion. Motion carried. Time: 10:10. Reconvened: 10:45 P.M. Councilman Reinke made a <br />motion to continue the public hearing until September 23, 1968. Councilman Laven seconded the motion. Motion <br />lost. 2 ayes., 7 nays. Councilman Allen made a motion the Ordinance go to the Council as unfavorable. <br />Councilman Craven seconded the motion. Motion carried. <br />HEARING OF INTERESTED CITIZENS REGARDING TRUCK TRAFFIC ON INNERBELT <br />At this time a group of citizens from the First District asked to be heard concerning the truck traffic on <br />the Innerbelt. Mr. Walter Rice, 410 W. Marion St., spoke in behalf of the residents of this area explaining <br />the noise of traffic and trucks using this Innerbelt. Others.protesting the Innerbelt noises were Mrs. Julia <br />Omacht, 436 N. Lafayette Blvd., Mr. Philip L. Nicar, 309 W. Marion, Miss Aphrodite Pappas, 512 W. Madison, <br />Miss Anna Pappas, also 512 W. Madison. Councilman Allen stated that the sewer drains have been put where <br />a person steps on them when stepping down from the cross walks. Councilman Laven made a motion this matter <br />be referred to the Council Traffic Committee for study. Councilman Reinke seconded the motion. Motion carried. <br />f <br />
