COMMITTEE OF THE WHOLE MEETING I JULY 8, 1968 <br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole <br />in the Council Chambers of City Hall on Monday July 8, 1968 at 8:10 P.M., eight members present, (Councilmen <br />Laven, Allen, Craven, Reinke, Grounds, Szymkowiak, Palmer and Zielinski). 1 absent (Councilman Wise). The <br />Invocation was given by Reverend Freemen A. Whetstone, Stewart Memorial Baptist Church. The meeting was <br />called to order by Chairman William W. Grounds, who presided. <br />ORDINANCE <br />AN ORDINANCE AUTHORIZING THE SALE AND <br />CONVEYANCE OF THREE PARCELS OF REAL <br />ESTATE LOCATED IN THE CITY OF SOUTH BEND, <br />INDIANA, AND OWNED BY THE CITY OF SOUTH <br />BEND, INDIANA <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were <br />given an opportunity to be heard thereon. Arthur Frisk, City Attorney, spoke in favor of the Ordinance, <br />and gave the location of the three parcels of real estate to be sold: Fire Station No. 5, located at <br />1000 Lincoln Way East, A lot located at 702 W. Colfax Ave., acquired for the innerbelt right of way when it <br />was first to go thru this section, and a 50 foot strip of property just west of Michigan Street on Angela, <br />the old railr "oad.right of way. He explained the property was no longer needediand the procedure necessary <br />to sell the property. Speaking against the Ordinance was Councilman Allen, who felt the fire station might <br />be needed later in the downtown renewal program, and could see no reason to be in a rush to sell it. Others <br />speaking against the Ordinance were;Miss Virginia Guthrie, executive secretary of the South Bend Civic Planning <br />Assn., Inc., who felt the station also should not be sold at this time; Councilman Szymkowiak, and Councilman <br />Zielinski; and Melvin Lesniewicz, 3718 Surrey Lane, a fireman. Councilman Allen made a motion to eliminate <br />the sale of the fire station from the Ordinancefor consideration at a later. date. Councilman Szymkowiak seconded <br />the motion. Motion Lost. Councilman Palmer questioned the possibility of leasing the station but was ad- <br />vised by City Attorney Arthur Frisk the city was prohibited from money making. Councilman Laven made a <br />motion the Ordinance go to the Council as favorable. Councilman Reinke seconded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE APPROPRIATING $5,000.00 FROM THE <br />GENERAL FUND TO ACCOUNT B -53, "REFUNDS, AWARDS <br />AND INDEMNITIES" IN THE OFFICE OF THE CITY <br />CONTROLLER. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were <br />given an opportunity to be heard thereon. City Controller James A. Bickel said the additional funds were <br />needed to pay claims against the city. Miss Virginia Guthrie, executive secretary of the South Bend Civic <br />Planning Assn., Inc., felt this was the type of emergency that could not be anticipated. Councilman Allen <br />made a motion the Ordinance go to the Council as favorable. Councilman Craven seconded the motion. Motion <br />carried. <br />ORDINANCE <br />AN ORDINANCE AMENDING CHAPTER 40 OF ORDINANCE <br />NUMBER 4608 -63 COMMONLY KNOWN AS THE MUNICIPAL <br />CODE OF SOUTH BEND, INDIANA. (Crumstown Highway <br />and Bendix Dr.) <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were <br />given an opportunity to be heard thereon. Attorney Edward N. Kalamaros, representing the Bendix Credit <br />Union, said the building to be erected would be a one -story building and would be a credit to the area. <br />Councilman Szymkowiak made a motion the Ordinance go to the Council as favorable. Councilman Reinke second- <br />ed the motion. Motion carried. <br />There being no further business before the Committee of the Whole, Councilman Allen made a motion to rise <br />and report to the Council. Councilman Palmer seconded the motion.
