Ca MITTEE OF THE WHOLE MEETING MARCH 25, 1968 Be it remembered that the Common Council of the City of South Bend, Indiana met in the Committee of the Whole in the Council Chambers of City Hall on Monday, March 25, 1968 at 8: P.M., with all members present. The Invocation was given by Reverend James 0. Banks, Sunnyside Presbyterian Church. The meeting was called to order by Chairman William W. Grounds, who presided. ORDINANCE AN ORDINANCE PROHIBITING CERTAIN PRACTICES OF DISCRIMINATION IN HOUSING ACCOMMODATIONS BECAUSE OF RACE, CREED, COLOR, NATIONAL ORIGIN OR ANCESTRY, AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF, AS AMENDED. This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were given an opportunity to be heard thereon. Speaking in favor of adoption of the Ordinance was Mayor Lloyd M. Allen. Others speaking in favor of the Ordinance were: Rev. Milton D. Will£ord, executive secretary of the St. Joseph County Council of Churches; Dr. Frank C. Toepp, of the Ecumenical commission of the Fort Wayne - South Bend Catholic Diocese; Van E. Gates, president of the South Bend- Mishawaka Area Chamber of Commerce; Dr. George Haley, of the United Community Services; Isadore Rosenfeld, of the Jewish Community Council, Jesse L. Dickinson, executive director of the South Bend Public Housing Authority, but speaking for the Urban League; Rev. Herbert Tetzlaff, pastor of St. Peter's United Church of Christ; Leo A. Newman, president of the South Bend Human Relations and Fair Employment Practices Commission; Dr. Eldridge H. MacDonald, 17570 Judy Lake Drive; Ray Hernandez, 702 E. South St.; Reginald Howard, NAACP Chairman; Bud Darden, 1929 Beverly Place; Robert Cook, 1005 Woodward; Pat Cool, 1007 W. Colfax; Paul Shearer, Chairman of the Lutheran Association; Homer Nesley, 607 Leland; Bill Whitman, for J.C.'s; John D. Green, 413 N. College; Charles Kroll, 323 Green Phillips, a Notre Dame Student; James D. Ulis, 715 N. Adams. Allen Nichols, 2806 Apple Tree Lane, questioned the legal procedure. Speaking against the Ordinance were Councilmen John Wise and Albert Palmer. Councilman Grounds, Chairman of Committee of the Whole, asked Councilman Craven to preside while he spoke on the issue. Councilman Laven made a motion to amend the Ordinance as follows: SECTION III - A Line 93 Add "To assist or" Change capital "T" to small *t" After "Participate" insert "with a person who is not a bona fide prospective buyer or renter" SECTION III - B Line 99 After person insert "who is not a bona fide prospective buyer or renter" SECTION IV Line 110 After four insert "rental" SECTION VII - B Line 148 Delete "and notarized" Line 149 After complaint insert "under oath" SECTION VII - C Line 161 Insert "No more than ninety" before the word Ninety Change capital "N" to small "n" SECTION VII - G Line 198 Delete word "and"
