<br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the 
<br />Whole in the Council Chambers of City Hall on Monday, March 11, at 8:00 P.M., with all members present. 
<br />The Invocation was given by Reverend Stanley M. Dodgson, First Baptist Church. The meeting was called to 
<br />order by Chairman William W. Grounds, who presided. 
<br />ORDINANCE 
<br />AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702 
<br />(Location: West side Phillipa Street, in 1600 block) 
<br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were 
<br />given an opportunity to be heard thereon. Councilman Wise made a motion that the Ordinance go to the 
<br />Council as favorable. Councilman Palmer seconded the motion. Motion carried. 
<br />ORDINANCE 
<br />AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 40 
<br />OF THE MUNICIPAL CODE OF SOUTH BEND, INDIANA 
<br />(Location: 805 -811 North Michigan St.). 
<br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were 
<br />given an opportunity to be heard thereon. Councilman Allen made a motion that the Ordinance go to the 
<br />Council as favorable. Councilman Szymkowiak seconded the motion. Motion carried. 
<br />ORDINANCE 
<br />AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION OF TRADES, 
<br />CALLINGS, INDUSTRIES, COMMERCIAL ENTERPRISES, AND THE LOCATION 
<br />OF BUILDINGS DESIGNED FOR SPECIFIED USES; TO REGULATE AND LIMIT 
<br />THE HEIGHT OF BUILDINGS HEREAFTER ERECTED OR ALTERED; TO REGULATE 
<br />AND DETERMINE THE AREA OF YARDS AND OTHER OPEN SPACES ABOUT 
<br />BUILDINGS; TO REGULATE AND DETERMINE THE DENSITY OF USE OF LAND 
<br />AND LOT AREAS, AND FOR SAID PURPOSES TO DIVIDE THE CITY INTO 
<br />DISTRICTS AND PRESCRIBE PENALTIES FOR THE VIOLATION OF ITS 
<br />PROVISIONS AND TO PROVIDE FOR ITS ENFORCEMENT AND A BOARD OF 
<br />ZONING APPEALS. 
<br />WHEREAS, THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, 
<br />DEEMS IT NECESSARY, IN ORDER TO CONSERVE THE VALUE OF PROPERTY IN 
<br />THE CITY AND TO THE END THAT ADEQUATE LIGHT, AIR CONVENIENCES OF 
<br />ACCESS AND SAFETY FROM FIRE AND OTHER DANGERS MAY BE SECURED, 
<br />THAT CONGESTION OF THE PUBLIC STREETS MAY BE LESSENED OR AVOIDED, 
<br />AND THAT THE PUBLIC HEALTH, SAFETY, COMFORT, CONVENIENCE, MORALS AND GEN- 
<br />ERAL WELFARE MAY OTHERWISE BE PROMOTED IN ACCORDANCE WITH A WELL 
<br />CONSIDERED AND COMPREHENSIVE PLAN FOR THE USE AND DEVELOPMENT OF 
<br />ALL PROPERTY THROUGHOUT THE CITY, AND 
<br />WHEREAS, THIS ORDINANCE IS SUBSTANTIALLY SIMILAR TO ORDINANCE 
<br />NO. 3702 OF THE CITY OF SOUTH BEND, INDIANA, COMMONLY KNOWN AS 
<br />THE ZONING ORDINANCE OF SAID CITY, WHICH SAID ORDINANCE WAS 
<br />ADOPTED ON JUNE 13, 1949, AND WHICH SAID ORDINANCE IS HEREBY 
<br />REPEALED. 
<br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were 
<br />given an opportunity to be heard thereon. Councilman Wise made a motion that the Ordinance go to the 
<br />Council as favorable. Councilman Szymkowiak seconded the motion. Motion carried. 
<br />ORDINANCE 
<br />AN ORDINANCE APPROVING A CONTRACT BETWEEN THE 
<br />WATER WORKS OF THE CITY OF SOUTH BEND, INDIANA, 
<br />AND PATTEN INDUSTRIES, INCORPORATED, HAMMOND, 
<br />INDIANA, FOR THE PURCHASE OF AN INDUSTRIAL,TRAC- 
<br />TOR WITH BACKHOE IN THE SUM OF $11,197.00. 
<br />This being the time heretofore set for public hearing on the above Ordinance, proponents and opponents were 
<br />given an opportunity to be heard thereon. Councilman Reinke made a motion that the Ordinance go to the 
<br />Council as: favorable. Councilman Laven seconded the motion. Motion carried. 
<br />ORDINANCE 
<br />AN ORDINANCE AMENDING SECTION 36 -6, 
<br />RATES OF FARE, OF THE MUNICIPAL CODE OF 
<br />THE CITY OF SOUTH BEND, INDIANA, 1962, 
<br />SAID ARTICLE BEING COMMONLY KNOWN 
<br />AS THE TAXI CAB ORDINANCE. 
<br />Mr. Laven made a motion that the Ordinance be withdrawn in compliance with a request of Mr. F. J. Nimtz, 
<br />Attorney; and that a new Ordinance be submitted. Councilman Allen seconded the motion. Motion carried. 
<br />There being no further business before the Committee of the Whole, Councilman Laven made a motion that the 
<br />members of the Committee rise and report to the Council, and that a recess be held at that time. Councilman 
<br />Allen seconded the motion. Motion carried. Time: 8 :50 P.M.
