<br />This ordinance had second reading. Councilman Szymkowiak made a motion that the ordinance pass,
<br />seconded by Councilman Newburn. The ordinance passed by a roll call vote of nine ayes (Councilmen
<br />Serge, Szymkowiak, Miller, Parent, Taylor, Kopczynski, Horvath, Newburn and Nemeth).

<br />ARTICLE 11, SECTIONS 2 -51 THROUGH
<br />2 -62 OF THE MUNICIPAL CODE OF SOUTH
<br />BEND, INDIANA, 1971, REDESIGNATED BY
<br />ORDINANCE NO. 5390 -72, AS ARTICLE 9
<br />OF CHAPTER 2 OF THE CODE, BY THE
<br />SUBSTITUTION OF A NEW ARTICLE 9 OF
<br />CHAPTER 2 ESTABLISHING THE SOUTH BEND
<br />HUMAN RIGHTS COMMISSION.
<br />This ordinance had second reading. Councilman Parent made a motion that the ordinance pass as
<br />finally amended in the Committee of the Whole meeting, seconded by Councilman Horvath. The motion
<br />carried. Councilman Miller then made a motion to insert the words "not to exceed $500.00" in
<br />Sec. 2 -56 (i)(1) in the eleventh line rather than as moved in the Committee of the Whole meeting,
<br />seconded by Councilman Kopczynski. The motion carried.

<br />ARTICLE 2, SECTIONS 11 -2 THROUGH
<br />11 -4 OF THE MUNICIPAL CODE OF SOUTH
<br />BEND, INDIANA, 1971, BY THE SUBSTITUTION
<br />OF A NEW ARTICLE 2 OF CHAPTER 11, THE
<br />SOUTH BEND HUMAN RIGHTS COMMISSION.
<br />This ordinance had second reading. Councilman Taylor made a motion that the ordinance state, in
<br />Section I, that Article 2 of Chapter 11 be repealed, seconded by Councilman Horvath. The motion
<br />carried. Councilman Newburn then made a motion that the ordinance pass, as amended, seconded by
<br />Councilman Kopczynski. The ordinance passed by a roll call vote of nine ayes (Councilmen Serge,
<br />Szymkowiak, Miller, Parent, Taylor, Kopczynski, Horvath, Newburn and Nemeth).

<br />RESOLUTION NO. 399 -73
<br />A RESOLUTION FINDING AND ADJUDGING
<br />THAT THE FINANCING OF FACILITIES FOR
<br />DAAL REALTY BY THE ISSUANCE BY THE
<br />CITY-OF SOUTH BEND, INDIANA, OF ITS
<br />ECONOMIC DEVELOPMENT REVENUE BONDS
<br />PERTAINING TO SUCH FACILITIES FOR
<br />SUCH ENTITY WILL BE OF BENEFIT TO
<br />THE HEALTH OR WELFARE OF THIS
<br />MUNICIPALITY, AND APPROVING THE
<br />FINANCING THEREFOR.
<br />WHEREAS, the Common Council of the City of South Bend, Indiana, heretofore has
<br />created the South Bend Development Commission, hereinafter referred to as "Commission ",
<br />pursuant to the provisions of the Municipal Economic Development Act of 1965, as amended,
<br />supplemented or added to, including but not limited to the amendments, supplements or
<br />additions thereto, hereinafter referred to as the "Act "; and
<br />WHEREAS, Daal Realty has filed an application with the Commission to finance the
<br />acquisition of real estate and the construction thereof of an industrial and commercial
<br />building (facilities) which will constitute economic development facilities resulting
<br />in a substantial number of new jobs as well as other benefits; and
<br />WHEREAS, in connection therewith the Commission had prepared and placed on file
<br />a report containing the subject matter as specified in Section 16 of IC -1973, 18 -6 -4.5
<br />and has forwarded copies thereof to the Chairman of the Area Plan Commission and to the
<br />Superintendent of the School Corporation in the area of which the facilities will be
<br />located, and has timely received favorable reports from each of them; and
