<br />ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING
<br />CHAPTER 21 OF THE CITY CODE OF SOUTH
<br />BEND, INDIANA, 1971, ALSO KNOWN AS
<br />ORDINANCE NO. 4990 -68, AS AMENDED, AND
<br />GENERALLY KNOWN AS THE ZONING ORDINANCE
<br />OF THE CITY OF SOUTH BEND, INDIANA, AS
<br />AMENDED, BY ADDING PROVISIONS RELATIVE
<br />TO NEIGHBORHOOD HEALTH CARE FACILITIES
<br />AND GROUP HOUSING QUARTERS.
<br />This ordinance had first reading. Councilman Miller made a motion to refer the ordinance to the
<br />Area Plan Commission and the Council Ordinance Committee, seconded by Councilman Parent. The moti
<br />carried.
<br />PRIVILEGE OF THE FLOOR
<br />Mr. Phillip Barkley, 50690 Portage Road, a St. Joseph County Councilman, stated that he wished to
<br />speak as chairman of the Clay, German and Portage Anti - Annexation Committee. He indicated that he
<br />wished to make the Council aware of the existence of the organization and the fact that the organi
<br />zation desired to offer any service it could to the Council regarding proposed annexations. He
<br />stated that his group wanted to meet with the Council at the Council's convenience in the near
<br />future to discuss the proceedings of annexations and to help expedite the proposed annexation of
<br />German Township. Councilman Serge asked when the next meeting of the group would be, and Mr.
<br />Barkley stated that the committee meets weekly, with the Steering Committee meeting Sunday after-
<br />noon, December 3, at 2:00 p.m., at the Wagner School. He indicated that there are no mass meeting
<br />scheduled at this time. Council President Nemeth asked if Mr. Barkley had any written material he
<br />wished the Council to look at and comment upon. Mr. Barkley stated that he had some material for
<br />the Council. Council President Nemeth asked if this material could be mailed to the members or
<br />left with the City Clerk. Mr. Barkley stated that, as soon as possible, he would forward the
<br />material to Councilman Newburn. He concluded that he felt the research done by the Anti - Annexatio
<br />Committee would be of value to the Council.

<br />ORDINANCE NO. 5597 -73 AN ORDINANCE AMENDING AND SUPPLEMENTING
<br />ORDINANCE NO. 4990 -68, CHAPTER 40 OF THE
<br />MUNICIPAL CODE OF THE CITY OF SOUTH BEND,
<br />INDIANA, FORMERLY REFERRED TO AS ZONING
<br />ORDINANCE NO. 3702, AS AMENDED (2017 WEST
<br />DUBAIL STREET) .
<br />City Clerk Irene K. Gammon stated that she had received a veto message from Mayor Miller, dated
<br />November 23, 1973, pertaining to the above ordinance which was passed by the Council on November 1
<br />1973. Council President Nemeth indicated that the Council would vote on the ordinance and an "aye
<br />vote would mean a vote to pass the ordinance and override the veto. The Mayor's veto was overridd
<br />by a roll call vote of seven ayes (Councilmen Serge, Szymkowiak, Miller, Taylor, Kopczynski, Newbu
<br />and Nemeth) and two nays (Councilmen Parent and Horvath).

<br />AN ORDINANCE AMENDING AND SUPPLEMENTING
<br />ORDINANCE NO. 4990 -68, CHAPTER 40 OF THE
<br />MUNICIPAL CODE OF THE CITY OF SOUTH BEND,
<br />INDIANA, FORMERLY REFERRED TO AS ZONING
<br />ORDINANCE NO. 3702, AS AMENDED (3414 EAST
<br />JEFFERSON BOULEVARD).
<br />City Clerk Irene K. Gammon stated that she had received a veto message from Mayor Miller, dated

<br />NEW BUSINESS
<br />Councilman Parent made a motion that the next meeting date of the Council be Monday, December 17,
<br />1973, at 7:00 p.m., seconded by Councilman Taylor. The motion carried.
<br />There being no further business to come before the Council, unfinished or new, Councilman Taylor
<br />made a motion that the Council adjourn, seconded by Councilman Kopczynski. The motion carried and
<br />the meeting adjourned at 12:05 a.m.
