<br />it remembered that the Common Council of the City of South Bend met in the Council Chambers of
<br />County -City Building on Monday, July 9, 1973, at 7:05 p.m., Council President Peter J. Nemeth
<br />siding. The meeting was called to order and the Pledge to the Flag was given.
<br />CALL PRESENT: Councilmen Serge, Szymkowiak, Miller,
<br />Taylor, Kopczynski, Horvath, Newburn
<br />and Nemeth.
<br />ABSENT: Councilman Parent.
<br />ilman Kopczynski made a motion to resolve into the Committee of the Whole, seconded by
<br />ilman Miller. The motion carried.
<br />�OMMITTEE OF THE WHOLE MEETING
<br />e it remembered that the Common Council of the City of South Bend met in the Committee of the
<br />hole on Monday, July 9, 1973, at 7:06 p.m., with eight members present. Chairman Odell Newburn
<br />resided.
<br />ouncil President Nemeth indicated that, since Items 3A and 3B were inter - related, both ordinances'
<br />ould be considered at the same time. Councilman Miller requested that a separate vote be taken
<br />or each ordinance.
<br />INANCES AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE
<br />CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LAND
<br />(NORTHWEST CORNER OF IRELAND ROAD - IRONWOOD DRIVE
<br />INTERSECTION)

<br />AN ORDINANCE AMENDING AND SUPPLEMENTING
<br />ORDINANCE NO. 4990 -68, CHAPTER 40 OF THE
<br />MUNICIPAL CODE OF THE CITY OF SOUTH BEND,
<br />INDIANA, FORMERLY REFERRED TO AS ZONING
<br />ORDINANCE NO. 3702, AS AMENDED (NORTHWEST
<br />CORNER OF IRELAND ROAD - IRONWOOD DRIVE INTERSECTION).
<br />This being the time heretofore set for public hearing on the above ordinances, proponents and
<br />opponents were given an opportunity to be heard. Mr. Charles Sweeney, Jr., Attorney at Law,
<br />1221 St. Joseph Bank Building, indicated that he represented Nohl and Betty Lueneburg, the peti-
<br />tioners in the above matter. He indicated that the land to be annexed was located at the northwes
<br />corner of Ireland Road and Ironwood Drive and was a voluntary annexation. He presented slides of
<br />the area and stated that, presently the property was zoned "C" in the county. He indicated that,
<br />after an area is annexed, the property must be rezoned, and the request for the property was "C"
<br />Commercial. He stated that there is a commercial establishment located one door to the east and
<br />is also zoned "C" in the county. Mr. Sweeney stated that the Area Plan Commission passed
<br />favorably on the rezoning at its meeting, with two members opposed and ten members in favor of the
<br />rezoning. He mentioned that the annexation of the property did not have to be considered by the
<br />Area Plan Commission, only the rezoning. He indicated that the site development plan purported to
<br />lay out three stages, they being: Phase I - erection of a commercial building to house the Burger
<br />Dairy Store; Phase II - construction of a commercial building; and Phase III - 60,000 square feet
<br />of office space for professional people in back. He indicated that the buildings on Ireland and
<br />Ironwood would be one -story and two -story on the north with parking in the rear. The petitioners
<br />had already donated 30 feet of right -of -way on Ironwood and 10 feet north of Ireland. Mr. Sweeney
<br />explained that the property north of the area was the retention basin and the other corners were,
<br />at present, vacant. The parcel in question is nine acres with an east -west exposure of 840 feet
<br />and a north exposure of 960 feet. He indicated that the developed area would be 110,000 square
<br />feet and parking facilities had been deemed adequate by the Area Plan Commission. Mr. Sweeney
<br />indicated that Mr. Helmet Weist had prepared the preliminary site plan and was available to answer
<br />any questions.
<br />Council President Nemeth asked about the assessed valuation of the existing improvements, and Mr.
<br />Sweeney indicated an estimate would be about two and a half million dollars less the value of the
<br />land, which would be gross valuation.
<br />Councilman Szymkowiak made a motion that the ordinance pertaining to the annexation of the proper
<br />go to the Council as favorable, seconded by Councilman Miller. The motion carried. Councilman

<br />the Council as favorable, seconded by Councilman Miller. The motion carried. (Councilman Taylor
<br />opposed).
