REGULAR MEETING MAY 29, 1973 <br />COMMITTEE OF THE WHOLE MEETING (CONTINUED) <br />ORDINANCE AN ORDINANCE PROVIDING FOR THE RECEIVING AND <br />CONVEYING OF A GIFT OF REAL PROPERTY TO THE <br />CIVIL CITY OF SOUTH BEND, INDIANA (MORRIS L. <br />MORRISON). <br />This being the time heretofore set for public hearing on the above ordinance, proponents and <br />opponents were given the opportunity to be heard. Mr. James Seitz, Director of the Department of <br />Public Parks, explained that this property was a street island-at the intersection of Twyckenham <br />and Ridgedale which the city has been maintaining for a number of years. Miss Virginia Guthrie, <br />Executive Secretary of the Civic Planning Association, asked about any back taxes on the property. <br />Councilman Horvath asked if this.-island was the one located by the fire station, and Mr. Seitz <br />indicated that the island in question was south down Twyckenham. Councilman Horvath asked about <br />the possibility of future widening, and Mr. Seitz indicated that, if the city owned the island, <br />there would be no problem. Council President Nemeth indicated that the ordinance stated that the <br />property was being conveyed to the City of South Bend subject to all unpaid taxes and assessments. <br />He felt this should be checked into and more information obtained before action by the Council was <br />taken. Mr. William J. Richardson, Director of the Department of Public Works, explained that, <br />normally, when property is transferred to the city, the person selling the property is required to <br />satisfy all unpaid taxes and liens. He felt this would be a similar case. Council President <br />Nemeth felt the Council had two alternatives, they being to either continue the ordinance until <br />the information requested was obtained or eliminate the clause pertaining to the unpaid taxes and <br />assessments. Councilman Horvath asked about the size of the island, and Mr. Seitz indicated that <br />he would guess it to be approximately 150 square feet. Councilman Taylor asked about the status <br />of ownership of the property on Leer Street and Fairview Avenue, and Mr. Seitz indicated that that <br />was city -owned property. <br />Councilman Parent made a motion to delete the clause pertaining to the unpaid taxes and assessment <br />and restrictions of record. The motion lost <br />then made a motion that the Committee of the <br />care of the matter in the Council portion of <br />motion carried. <br />due to lack of a second. Council President Nemeth <br />Whole make no recommendation at this time and take <br />the meeting, seconded by Councilman Taylor. The <br />ORDINANCE AN ORDINANCE FOR THE TRANSFER OF FUNDS WITHIN <br />THE FIRE DEPARTMENT BUDGET IN THE AMOUNT OF <br />$5,880.00 FROM ACCOUNT Q -11, "SERVICES PERSONAL ", <br />TO ACCOUNT Q -262, "MEDICAL ", IN THE AMOUNT OF <br />$2,500.00 AND TO ACCOUNT Q -726, "OTHER EQUIPMENT" <br />IN THE AMOUNT OF $3,380.00, ALL ACCOUNTS BEING <br />WITHIN THE GENERAL FUND. <br />This being the time heretofore set for public hearing on the above ordinance, proponents and <br />opponents were given an opportunity to be heard. Miss Virginia Guthrie, Executive Secretary of <br />the Civic Planning Association, asked about the equipment involved, and Mr. Joseph Nagy, Assistant <br />Fire Chief, explained that the transfer was being requested in order to purchase two cardiopulmona <br />resuscitators to update the present equipment. He indicated that the units would be used on the <br />department's two ambulances. Miss Guthrie asked how much of a delay there would be in receiving <br />the units, and Mr. Nagy indicated that it would be approximately three weeks. <br />Councilman Szymkowiak made a motion that the ordinance go to the Council as favorable, seconded by <br />I <br />Councilman Taylor. The motion carried. <br />ORDINANCE AN ORDINANCE TO APPROPRIATE $64,800.00 FROM THE <br />LOCAL ROAD AND STREET FUND AND $7,200.00 FROM <br />THE CUMULATIVE CAPITAL IMPROVEMENT FUND FOR <br />PROJECT R & S 53 (REVISED) - SAMPLE STREET FROM <br />OLIVE STREET TO CHAPIN STREET. <br />This being the time heretofore set for public hearing on the above ordinance, proponents and <br />opponents were given an opportunity to be heard. Mr. William J. Richardson, Director of the <br />Department of Public Works, made the presentation for the ordinance. He explained that the total <br />amount of the request was for the engineering of plans and specifications for the four - laning of <br />Sample Street. He indicated that it was anticipated that construction would be commenced in 1975. <br />Miss Virginia Guthrie, Executive Secretary of the Civic Planning Association, asked if there were <br />buildings west of Chapin Street that would interfere with the road construction. Mr. Richardson <br />indicated that there were and, because of that, it was hoped that the study could be accomplished <br />to determine what would be involved in the actual construction. Council President Nemeth made a <br />motion to amend the ordinance by inserting the words "engineering of the" in the fourth line of <br />Section I immediately following the word "the ", seconded by Councilman Parent. The motion <br />carried. Councilman Miller asked about what percentage of the total construction cost was the <br />engineering portion, and Mr. Richardson indicated that the total was $72,000, with preliminary <br />estimates in the range of $1,000,000 which would be approximately 7.20. Councilman Miller asked <br />if this was a flat curve, and Mr. Richardson indicated that the percentage becomes less with the <br />cost of the project. He indicated that there are contingency items included which are not costs <br />paid to the consulting engineer. Councilman Miller indicated that, in the Civic Center project, <br />provisions were made to eliminate a higher cost. Mr. Richardson indicated that, as far as a <br />maximum cost, the curve would be utilized. He also mentioned that there are paragraphs in the <br />contract that require the engineer to proceed with certain aspects of the job. Councilman Miller <br />asked if this money would revert back if all of it was not used, and Mr. Richardson indicated that <br />it would. He mentioned that he tried to keep the projects down to as small amount as possible so <br />that the funds could be stretched farther. Councilman Miller asked if this ordinance would replac <br />the previous ordinance, and Mr. Richardson indicated that it would. He also indicated that, out <br />of the $7,000, the work that has already been done would be credited to the overall project. <br />Councilman Miller asked if Murphy was the engineer chosen, and Mr. Richardson indicated that he <br />was selected by the Board of Public Works. Councilman Miller indicated that the city was involved <br />with other million dollar projects and he expressed concern about the city pushing its limit in <br />the road funds for these projects. Mr. Richardson indicated that his working balance, after <br />$800,000 for the Ironwood project, would be approximately $400,000 with another $500,000 coming in <br />yet this year. He indicated that land acquisition takes a great deal of time and the project may <br />not actually be started until 1975 or 1976 depending on the number of problems encountered. <br />
