<br />ORDINANCE NO. 5454 -72 AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68 AS
<br />AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE
<br />OF THE CITY OF SOUTH BEND, INDIANA.
<br />(NE CORNER, MAIN ST. AND IRELAND ROAD)
<br />This ordinance had second reading. Councilman Taylor made a motion that the ordinance be passed,
<br />seconded by Councilman Kopczynski. The motion carried by a roll call vote of nine ayes (Council-
<br />men Serge, Szymkowiak, Miller, Parent, Taylor, Kopczynski, Horvath, Newburn and Nemeth).
<br />ORDINANCE NO. 5455 -72 AN ORDINANCE FOR TRANSFER OF $40,000 FROM
<br />ACCOUNT MVH -12 "WAGES- SERVICES PERSONAL ",
<br />MVH -52 "RENTS- CURRENT CHARGES ", AND MVH- 722,
<br />"MOTOR EQUIPMENT- PROPERTIES ", TO ACCOUNT
<br />MVH -42 "STREETS AND ALLEY MATERIALS ", ALL
<br />`ACCOUNTS BEING WITHIN THE STREET DEPARTMENT
<br />BUDGET OF THE MVH FUND.
<br />This ordinance had second reading. Councilman Parent made a motion for passage of the ordinance,)
<br />seconded by Councilman Szymkowiak. The ordinance passed by a roll call vote of nine ayes
<br />(Councilmen Serge, Szymkowiak, Miller, Parent, Taylor, Kopczynski, Horvath, Newburn and Nemeth }.
<br />ORDINANCE NO. 5456 -72 AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION
<br />IN THE AMOUNT OF $29,000.00 FROM THE GENERAL
<br />FUND OF THE CUMULATIVE CAPITAL IMPROVEMENT
<br />FUND TO THE FOLLOWING ACCOUNTS IN THE CUMULATIVE
<br />CAPITAL IMPROVEMENT FUND: 72 "PROPERTIES ",
<br />$15,000.00; 44 "OTHER MATERIALS ", $14,000.00;
<br />ALL':` -BEING WITHIN THE CUMULATIVE CAPITAL IMPROVE-
<br />MENT FUND.
<br />This ordinance had second reading. Councilman Newburn made a motion that the ordinance pass,
<br />seconded by Councilman Taylor. The ordinance passed by a roll call vote of nine ayes (Council-
<br />men Serge, Szymkowiak, Miller, Parent, Taylor, Kopczynski, Horvath, Newburn and Nemeth).
<br />ORDINANCE NO. 5457 -72 AN ORDINANCE AMENDING CITY CODE SEC. 15 -3
<br />PROHIBITING THE SOUNDING OF LOCOMOTIVE WHISTLES
<br />OR HORNS WITHIN THE CITY OF SOUTH BEND TO PROHIBIT
<br />THE SOUNDING OF LOCOMOTIVE WHISTLES OR HORNS AT
<br />CERTAIN CROSSINGS.
<br />This ordinance had second reading. Councilman Kopczynski said that he spoke in opposition to
<br />this ordinance because of-:not' including the crossings in other areas of the city in the ordinance
<br />He said he felt the ordinance should cover the entire city. Councilman Miller made a motion
<br />that the ordinance pass, seconded by Councilman Taylor. City Attorney Charles A. Sweeney, Jr.
<br />said it had been called to his attention that most of the crossings in the 1st and 2nd districts
<br />were unprotected and were left out for that reason. Councilman Horvath said he felt this ordin-
<br />ance should be passed as a test case and the Council could then pass ordinances covering other
<br />crossings. The question was called and the ordinance passed by a roll call vote of nine ayes,
<br />(Councilmen Serge, Szymkowiak, Miller, Parent, Taylor, Kopczynski, Horvath, Newburn and Nemeth).
<br />RESOLUTIONS
<br />RESOLUTION NO. 340 -72 A RESOLUTION FOR TRANSFER OF FUNDS IN THE GENERAL
<br />PARK FUND - $16,420.56. THE TRANSFER IS BEING
<br />MADE IN THE SAME BUDGET CLASSIFICATIONS WITHIN
<br />THE GENERAL�PARK FUND.
<br />WHEREAS, certain extraordinary conditions have developed since the adoption of the existing
<br />annual budget so that it is now necessary to transfer money from one account to another in the
<br />same category in the annual budget for various functions of the Department of Public Parks to
<br />meet such extraordinary emergencies and
<br />WHEREAS, it has been ascertained that certain accounts in the Park General Fund have more money
<br />than is needed at this time
<br />NOW, THEREFORE, BE IT RESOLVED,- by the Common Council of the City of South Bend:
<br />SECTION 1. That the following accounts be reduced in the amounts set opposite said accounts,
<br />to -wit:
