6 21 4 <br />REGULAR MEETING JULY 28, 1980 <br />Be it remembered that the Common Council of the City of South Bend met in the Council Chambers <br />of the County -City Building on Monday, July 28, 1980, at 7:00 p.m. The meeting was called to <br />order and the Pledge to the Flag was given. <br />ROLL CALL PRESENT: Council Members Serge, Szymkowiak, Beck, Taylor, Kopczynski, <br />Crone, Dombrowski, Voorde and McGann <br />ABSENT: None <br />REPORT FROM THE SUB - COMMITTEE ON MINUTES <br />To the Common Council of the City of South Bend: <br />Your sub- committee on the inspection and supervision of the minutes would respectfully <br />report that it has inspected the minutes of the July 14, 1980 meeting of the Council and found <br />them correct. <br />The sub - committee, therefore, recommends that the same be approved. <br />/s/ Lewis A. Crone <br />Council Member Serge made a motion that the minutes of the July 14, 1980, meeting of the Council <br />be accepted and placed on file, seconded by Council Member Taylor. The motion carried. <br />"A061 <br />Council Member Szymkowiak gave the Utilities Committee report on Bill No. 46 -80. Council Member <br />Kopczynski indicated that on page 2 of the report, where it indicated a salary of $25,000, it <br />should be a budget of $25,000. He made a motion to correct the report, seconded by Council <br />Member Dombrowski. The motion carried. Council Member Kopczynski made a motion to accept these <br />minutes as amended, seconded by Council Member Taylor. The motion carried. <br />Council Member Crone gave the Personnel and Finance Committee report on Bills Nos. 81 -80, 82 -80, <br />and 85 -80. <br />Council Member Dombrowski gave the Older Adults Committee report. <br />Council Member Voorde gave the Human Resources Committee report on tax abatement for the propert` <br />located at Grant and W. Washington and Beacon Heights. He said the c onmittee recommended both <br />receive tax abatement. <br />Council Member Dombrowski made a motion to resolve into the Committee of the Whole, seconded <br />by Council Member Kopczynski. The motion carried. <br />COMMITTEE OF THE WHOLE <br />Be it remembered that the Common Council of the City of South Bend met in the Committee of the <br />Whole on Monday, July 28, 1980, at 7:13 p.m., with nine members present. Chairman Szymkowiak <br />presiding. <br />BILL NO. 46 -80 <br />A BILL AMENDING CHAPTER 17, SEWERS AND WATER, OF THE MUNICIPAL CODE <br />OF THE CITY OF SOUTH BEND, INDIANA, BY THE ADDITION OF A NEW ARTICLE <br />7 ENTITLED SEWER SERVICE FUND AND CHARGES. <br />This being the time heretofore set for public hearing on the above bill, proponents and opponent <br />were given an opportunity to be heard. Council Member Kopczynski made the presentation for the <br />bill. He indicated this bill was brought about by many people having sewer problems they could <br />not afford. He indicated the rate would be 75� a month, which will be enough revenue to cover <br />the cost. He said he felt the Council should monitor this fund very closely. He made a motion <br />to substitute an amended bill for the original bill, seconded by Council Member Dombrowski. The <br />motion carried. He indicated that Patrick McMahon, Director of Public Works, had also submitted <br />an amended version of the bill. He indicated that he would now add some of the Administration's <br />recommendations, taken from the bill given to the Council at their informal meeting. In Section <br />17 -58 add paragraphs (e) and (f), taken from McMahon's bill (Section 17 -60 (a) and (b); Section <br />17 -60 should be changed from two billing periods to "for a period of 120 days "; Section 17 -57, <br />remove "a private sewer connection "; in Section 17 -61 insert (a) from Mr. McMahon's bill, <br />(Section 17 -62) and the present paragraph (a) becomes (b); Section 17 -62, to the title add <br />Monthly Repair List Shall be Filed with Common Council, and add a new paragraph (c) to read <br />"In addition to the bi- annual report, the Board of Waste Water Commissioners shall file a <br />monthly report with the Council's Utility Committee detailing the following: 1) Name of property <br />owner and location of sewer repair (designated by the common address of the property). 2) Name <br />of contractor who performed the sewer repair. 3) The amountof sewer repair with an attached de- <br />tailed claim. "; seconded by Council Member Dombrowski. The motion carried. Patrick McMahon, <br />Director of Public Works, indicated he did not think it was necessary to have a monthly report. <br />He asked the Council to consider the amended bill given to them tonight. Council Member <br />Kopczynski said he thought it was proper for the Council to monitor the new program. He made <br />a motion to amend the bill in Section 17 -56 (b), first sentence by adding not industrial or not <br />bulk water users, seconded by Council President McGann. The motion carried. Mr. Maurice Cohn, <br />725 E. Eckman, indicated that 75� a month with a $1,000 deductible was too high. Council Member <br />Dombrowski made a motion to recommend this bill to the Council favorable, as amended, seconded <br />by Council Member Taylor. The motion carried. <br />
