This resolution shall be in full force and effect from and after its adoption <br />by the Common Council and approval by the Mayor. <br />/s /Lewis A. McGann <br />Member of the Common Council <br />A public hearing was held on the resolution at this time. Ms. Micki Dobski, Assistant Director <br />of the Youth Service Bureau, indicated this was an application for Federal assistance through <br />HUD. He said this request was for $52,500 for continuation funding of the Youth Service Bureau. <br />Council Member Serge made a motion to adopt this resolution, seconded by Council Member Taylor. <br />The resolution was adopted by a roll call vote of nine ayes. <br />RESOLUTION <br />A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA, RECOGNIZING ITS RESPONSIBILITY UNDER STATE <br />LAW TO ENACT THE PAY ORDINANCE FOR FIREFIGHTERS AND POLICE - <br />MEN AND RECOGNIZING THE NEED TO ENTER INTO GOOD FAITH <br />NEGOTIATIONS WITH THE FIREFIGHTERS AND POLICEMEN. <br />A public hearing was held on the resolution at this time. Council Member Crone indicated it was <br />her intention to provide an alternative means for the Council to establish their intent for labor <br />negotiations, should a majority of the Council determine that.further study of the bill was <br />needed. She indicated she had amended her resolution by stating that the Council authorizes the <br />Mayor and his designates, including at least two (2) representatives from the Common Council to <br />enter into good faith negotiations. She indicated it was her intention to try and bring the <br />Council together on this issue. She indicated that since the Council did not support this <br />resolution she would withdraw it, and support Council Member Dombrowski's resolution. Council <br />Member Voorde indicated he was in favor of this concept at this particular time because of the <br />unique capabilities of the Administration. He indicated the Mayor has handled these neogitations <br />for several years, and Mr. MacMilli.an, who has worked on these negotiations for the past two <br />years, has recently jointed the Administration. He indicated he was in support of some type <br />of formal guidelines after this year. Council Member Crone made a motion to strike this resolu- <br />tion, seconded by Council Member Beck. The motion carried. <br />RESOLUTION NO. 768 -80 <br />A RESOLUTION SETTING FORTH.CERTAIN GUIDELINES FOR THE SALARY <br />NEGOTIATIONS BETWEEN THE COMMON COUNCIL AND THE FIREFIGHTERS <br />AND POLICE OFFICERS. <br />WHEREAS, Indiana Qode Section 18- 1 -11 -2 authorizing t,he'Common:.Counc;il to set the-annual <br />pay of all police - officers and firefighters; " and <br />WHEREAS, significant changes in the area of labor negotiations have taken place since the <br />State law was enacted in 1905; and <br />WHEREAS, the Common Council desires to set forth certain guidelines for the upcoming salary <br />negotiations. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, <br />as follows: <br />SECTION I. The Common Council believes in the concept of collective bargaining when <br />setting salaries for police officers and firefighters. In the interest of formalizing a <br />structure for the upcoming salary negotiations the following guidelines are adopted. <br />SECTION II. Members of the Common Council and their designates shall meet with representa- <br />tives of the firefighters (sworn members of the department excluding chiefs and battalion chiefs) <br />and their designates,and representatives of the.police officers (sworn members of the department <br />excluding chiefs and capti..n) and their designates respectively for the purpose of setting <br />salaries for the 1981 calendar year. <br />SECTION III. Salary negotiations shall be initiated by the firefighters and police officers <br />respectively by each of them submitting to the Common Council a salary proposal on or before <br />March 31, 1980. Within ten (10) days of the receipt of such proposal (s) the Council shall <br />meet privately with the representatives of the firefighters and police officers respectively to <br />discuss such proposal(s). <br />SECTION IV. In the event that the parties are unable to reach agreement on salaries by the <br />first Monday in June, the partices may submit a request to the Federal Mediation and Concilia- <br />tion Service for a mediator. Recommendations of the meadiator shall be reported back to the <br />full membership of the parties for acceptance, modification, or rejection prior to the last <br />Common Council meeting in July. <br />SECTION V. The Salary ordinances for the firefighters and police officers respectively <br />shall be adopted by the last meeting of the Common Council in July. <br />. SECTION VI. This Resolution shall be in full force and effect from and after its adoption <br />by the Common Council and approval by the Mayor. <br />/s /Lewis A. Mr. George Herendeen, attorney for the F.O.P., indicated this resolution was a <br />waste of ink. He indicated that the Council already has this obligation. He indicated this <br />resolution should be amended in Section II where it indicates that just sworn members could <br />be on the negotiation team. Council Member Dombrowski made a motion to add "and their designates' <br />after the words chiefs) and captain), seconded by Council Member Kopczynski. The motion carried <br />Council Member Kopczynski made a motion to adopt this resolution, seconded by Council Member <br />Taylor. The resolution was adopted by a roll call vote of eight ayes and one nay (Council Member <br />Voorde.) <br />
