REGULAR MEETING AUGUST 13 1979 <br />REGULAR MEETING RECONVENED <br />Be it remembered that the regular <br />reconvened in the Council Chambers <br />Council President Parent presiding <br />BILLS, SECOND READING <br />G <br />meeting of the Common Council of the City of South Bend <br />on the fourth floor of the County -City Building at 8:37 p.m., <br />and eight members present. <br />ORDINANCE NO. 6618 -79 AN ORDINANCE APPROPRIATING $16,350.00 FROM THE FEDERAL <br />ASSISTANCE GRANT, COMMONLY REFERRED TO AS GENERAL REVENUE <br />SHARING, FOR VARIOUS PUBLIC WORKS PROGRAMS TO BE ADMINISTERED <br />BY THE CITY OF SOUTH BEND THROUGH ITS DEPARTMENT OF PUBLIC <br />WORKS. <br />This bill had second reading. Council Member Miller made a motion to pass this bill, seconded <br />by Council Member Horvath. The bill passed by a roll call vote of eight ayes. <br />ORDINANCE- NO'.­6619 -79 <br />AN ORDINANCE APPROPRIATING $12,000.00 OF YOUTH SERVICE <br />BUREAU MONIES FROM THE CITY OF SOUTH BEND YOUTH SERVICE <br />BUREAU OPERATIONS FUND FOR VARIOUS YOUTH SERVICE BUREAU <br />ACTIVITIES DURING THE PERIOD JULY 1, 1979 THROUGH <br />JUNE 30, 1980. <br />This bill had second reading. Council Member Miller made a motion to pass this bill, seconded <br />by Council Member Dombrowski. The bill passed by a roll call vote of eight ayes. <br />ORDINANCE NO. 6620 -79 AN ORDINANCE APPROPRIATING $95,000 FROM THE FEDERAL ASSISTANCE <br />GRANT FUND, COMMONLY REFERRED TO AS REVENUE SHARING, FOR THE <br />PURCHASE OF DIESEL FUEL AND GASOLINE, TO BE ADMINISTERED BY <br />THE CITY OF SOUTH BEND, THROUGH ITS DEPARTMENT OF ADMINISTRATION <br />AND FINANCE. <br />This bill had second reading. Council Member Serge made a motion to pass this bill, seconded <br />by Council Member Dombrowski. The bill passed by a roll call vote of eight ayes. <br />ORDINANCE NO. 6621 -79 AN ORDINANCE AMENDING CHAPTER 7, ARTICLE 5, SECTIONS 7 -76, 7 -79, <br />7 -80, 7 -81 AND 7 -82 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH <br />BEND, INDIANA, COMMONLY KNOWN AS THE SCRAP AND JUNK DEALERS <br />ORDINANCE. <br />This bill had second reading. Council Member Miller made a motion to amend the bill, as amended <br />in the Committee of the Whole, seconded by Council Member Dombrowski. The motion carried. <br />Council Member Serge made a motion to pass the bill, as amended, seconded by Council Member <br />Dombrowski. The bill passed by a roll call vote of eight ayes. <br />RESOLUTIONS <br />RESOLUTION NO. 711 -79 <br />A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND. <br />A PROPOSAL FOR A GENERAL RESOLUTION APPROVING THE FINDING OF <br />THE SOUTH BEND ECONOMIC DEVELOPMENT COMMISSION WITH RESPECT <br />TO THE ISSUANCE OF REVENUE BONDS IN AN AMOUNT NOT EXCEEDING <br />ONE MILLION DOLLARS ($1,000, -000.00) FOR FINANCING OF CERTAIN <br />ECONOMIC DEVELOPMENT FACILITIES TO BE UNDERTAKEN BY EXPRESS <br />FREIGHT LINES, INC., AND AUTHORIZING AND COMMITTING THE CITY <br />TO PROCEED WITH SUCH PROJECT; SUBJECT TO FfNAL ACTION BY THIS <br />COUNCIL WITH RESPECT TO THE TERMS AND CONDITIONS OF SUCH <br />FINANCING AND THE OBTAINING OF ALL APPROVALS AS MAY BE REQUIRED <br />UNDER IC- 6 -4.5. <br />WHEREAS, the City of South Bend, Indiana ( "City "), is authorized by IC 18 -6 -4.5 ( "Act ") <br />to issue revenue bonds for the purpose of financing the acquisition, installation, and con- <br />struction of economic development facilities; <br />WHEREAS, the City has been advised that there is under consideration a proposal of EXPRESS <br />FREIGHT LINES, INC., a Wisconsin corporation (the "Company "), to construct in St. Joseph County, <br />Indiana, a truck terminal and related facilities (the "Project ") described in Exhibit A hereto; <br />WHEREAS, the Company has proposed that the City issue its revenue bonds imder the Act <br />to finance the acquisition, installation and construction of the Project under a financing <br />agreement whereby the proceeds of such bonds would be utilized to acquire, install and construct <br />the Project and the Company would make payments sufficient to pay the principal of, premium, <br />if any, and interest on such bonds; the Company has further advised the City that a determination <br />by the City to accept such a proposal for financing the Project will constitute a substantial <br />inducement to the Company to proceed with the Project; and the Company has agreed to pay the <br />costs of the City whether or not such revenue bonds are issued and the financing agreement con- <br />summated; <br />WHEREAS, the South Bend Economic Development Commission has rendered a Report of the South <br />Bend Economic Development Facilities for EXPRESS FREIGHT LINES, INC., and the executive director <br />of the St. Joseph County Plan Commission and the Superintendent of the South Bend Community <br />School Corporation have been given an opportunity to comment thereon; <br />
