REGULAR MEETING NOVEMBER 6, 1978 <br />REGULAR MEETING RECONVENED (CONTINUED) <br />RESOLUTION NO. 659 -78 <br />A RESOLUTION OF THE COMMON COUNCIL OF THE,;CITY OF <br />SOUTH BEND APPROVING THE INTENTION OF THE MAYOR, <br />ACTING THROUGH THE DEPARTMENT OF REDEVELOPMENT, <br />TO ENTER INTO AN AGREEMENT WITH THE AMERICAN CITY <br />CORPORATION FOR THE PURPOSE OF PERFORMING A MARKET <br />STUDY IN CONJUNCTION WITH THE CENTURY MALL PROJECT. <br />WHEREAS, the Common Council of the City of South Bend recognizes the importance of <br />achieving the highest and best use of land located within the Century Business District; and <br />WHEREAS, the Common Council has previously articulated its support of an urban renewal <br />project known locally as "Century Mall;" and, <br />WHEREAS, the Common Council recognizes and agrees there exists a need to perform a <br />market analysis in connection with the Century Mall Project. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend that: <br />SECTION I. The intention of the Mayor, acting through the Department of Redevelopment, <br />to enter into an agreement with the American City Corporation for the purpose of performing <br />a market study in connection with the Century Mall Project is hereby approved. <br />SECTION II. The intention of the St. Joseph Bank and Trust Company to fund one -half of <br />the cost of the market study is hereby recognized and commended as this action represents <br />yet another example of the formation of a creative public sector /private sector partnership <br />which will greatly benefit the citizens of our community. <br />SECTION III. This resolution shall be in full force and effect from and after its passage <br />by the Common Council and its approval by the Mayor. <br />/s/ Mary Christine Adams <br />Member of the Common Council <br />A public hearing was held at this time on the resolution. Mr. Carl Ellison indicated that this <br />resolution seeks Council's consurrance that a need exists to perform a market analysis in con- <br />nection with the Century Mall Project. He said this study would include a market analysis <br />report, retail center concept with development objectives, preliminary development arithmetic <br />with estimates of public and private investments required. He said the report would be prepared <br />within a four to six month period and will cost $75,000, with an additional reimbursable fee <br />not to exceed ten percent of the basic fee. Council Member Szymkowiak made a motion to adopt <br />this resolution, seconded by Council Member Taylor. The resolution was adopted by a roll call <br />vote of nine ayes. <br />BILLS. FIRST READING <br />BILL NO. 209 -78 A BILL APPROPRIATING $39,900.00 FROM-THE EQUAL EMPLOYMENT <br />OPPOR'T'UNITY FUND TO . BE ADMINISTERED'_ BY`:THE CITY OF SOUTH <br />BEND-THROUGH ITS HUMAN RIGHTS COMMISSION AND DEPARTMENT OF <br />HUMAN RESOURCES AND-ECONOMIC DEVELOPMENT: <br />This bill had first reading. Council Member Miller made a motion to set it for public hearing <br />and second reading November 20, 1978, seconded by Council Member Adams. The motion carried. <br />BILL NO. 210 -78 A BILL AMENDING CHAPTER 2, ARTICLE 8, SECTION 2- 120(a) <br />OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, <br />PERTAINING TO THE ANNUAL VACATION -FOR CITY PERSONNEL. <br />This bill had first reading. Council Member Miller made a motion to set this bill for public <br />hearing and second reading November 30, 1978, seconded by Council Member Dombrowski. The motion <br />carried. <br />BILL NO. 211 -78 A BILL APPROPRIATING $142,062.00 FROM THE SEWAGE WORKS <br />DEPRECIATION FUND TO THE SEWAGE WORKS OPERATION AND <br />MAINTENANCE FUND FOR THE PURCHASE OF MOTOR EQUIPMENT <br />TO BE ADMINISTERED BY THE CITY OF SOUTH BEND THROUGH <br />ITS BUREAU OF SANITATION. <br />This bill had first reading. Council Member Miller made a motion to set this bill for public <br />hearing and second reading November 20, 1978, seconded by Council Member Taylor. The motion <br />carried. <br />BILL NO. 212 -78 <br />A BILL APPROPRIATING ALL.PARKING GARAGE FEES AND FUNDS <br />AND PARKING VIOLATION FINES FOR THE YEAR 1979 TO THE <br />BOARD OF PUBLIC WORKS OF THE CIVIL CITY OF SOUTH BEND, <br />INDIANA, FOR THE USES AND PURPOSES SET FORTH THEREIN, <br />IN ACCORDANCE WITH CHAPTER 190 OF THE ACTS OF THE <br />GENERAL ASSEMBLY OF THE STATE OF INDIANA OF 1955. <br />This bill had first reading. Council Member Miller made a motion to set it for public hearing <br />and second reading November 20, 1978, seconded by Council Member Taylor. The motion carried. <br />BILL NO. 213 -78 A BILL APPROPRIATING MONIES FOR THE PURPOSE OF DEFRAYING <br />THE EXPENSES OF THE BUREAU OF WATER OF THE CITY OF SOUTH <br />BEND, INDIANA, FOR THE FISCAL YEAR BEGINNING JANUARY 1, <br />1979, AND ENDING DECEMBER 31, 1979, INCLUDING ALL OUT- <br />STANDING CLAIMS AND OBLIGATIONS, AND FIXING A TIME WHEN <br />THE SAME SHALL TAKE EFFECT. <br />This bill had first reading. Council Member Miller made a motion to refer this bill to the <br />Utilities Committee, and set it for public hearing and second reading November 20, 1978, <br />seconded by Council Member Taylor. The motion carried. <br />
