REGULAR MEETING SEPTEMBER 26, 1977 <br />COMMITTEE OF THE WHOLE MEETING (CONTINUED) <br />This being the time heretofore set for public hearing on the above bill, proponents and opponent: <br />were given an opportunity to be heard. Mr. John Stancati, Director of Public Works, made the <br />presentation for the bill. He said the Water Works had been in this building since 1930. He <br />said it has outlived its usefulness. He said they would like to have this Judy done to deter- <br />mine it if was feasible to remain in the building. He said this study was needed, in that the <br />maintenance on the building is become very expensive. Council Member Kopczynski indicated that <br />Mr. Stancati, as manager of the Water Works, should know their requirements. He said in view <br />of this, he felt that this $3,500 should not be spent for a feasibility study. He made a motion <br />that this bill be defeated by Council, secon (ded by Council President Parent. Council Member <br />Adams asked what repair had been done to the building. Mr. Stancati briefly covered the repairs <br />that have been made, which totalled $10,000. Council President Parent indicated that the re- <br />quest for money implies that there is a need that we are going to do something, either remodel <br />the building, expand or build a new one, and this was the first he had heard that they were <br />even contemplating such a thing. He said he was not contemplating building a new building, <br />or expanding this one. He said they did not need to spend $3,500 for a study. He said an in- <br />house study could be made, as the City had competent people who could accomplish this. Mr. <br />Stancati indicated that he had asked the Engineering Department for help and they told him that <br />he needed an architect. A roll call vote was taken on the motion and it passed by a vote of <br />five ayes (Council Members Serge, Kopczynski, Adams, Horvath and Parent) and three nays (Council <br />Members Szymkowiak, Miller and Taylor). <br />There being no further business to come before the Committee of the Whole, Council Member Adams <br />made a motion to rise and report to the Council, seconded by Council Member Kopczynski. The <br />motion carried. <br />REGULAR MEETING RECONVENED <br />Be it remembered that the regular meeting of the Common Council of the City of South Bend re- <br />convened in the:Council Chambers on the fourth floor of the County -City Building at 7:53 p.m., <br />Council President Parent presiding and eight Council Members present. <br />BILLS, SECOND READING <br />BILL NO. 59 -77 <br />A BILL AMENDING CHAPTER 5, ANIMALS, OF THE MUNICIPAL <br />CODE OF THE CITY OF SOUTH BEND, INDIANA. <br />Council Member Miller made a motion to continue public hearing and second reading on this bill <br />until October 10, 1977, seconded by Council Member Adams. The motion carried. <br />ORDINANCE NO. 6230 -77 AN ORDINANCE AMENDING CHAPTER 9, GENERALLY KNOWN AS <br />THE FIRE PREVENTION ORDINANCE, REGULARING AND SETTTING <br />STANDARDS FOR SAFEGUARDING OF LIFE AND PROPERTY FROM <br />THE HAZARDS OF FIRE AND EXPLOSION ARISING FROM THE <br />STORAGE, HANDLING AND USE OF HAZARDOUS SUBSTANCES, <br />MATERIALS AND DEVICES, AND FROM CONDITIONS HAZARDOUS <br />TO LIFE OR PROPERTY IN THE USE OR OCCUPANCY OF BUILD- <br />INGS OR PREMISES; SETTING STANDARDS IN DETERMING THE <br />ACCEPTABILITY OF INSTALLATIONS OR PROCEDURES, EQUIP- <br />MENT OR MATERIALS IN THE USE OR OCCUPANCY OR BUILDINGS <br />OR PREMISES; PROVIDING FOR A FIRE BOARD OF APPEALS; <br />PROVIDING FOR BONFIRE, TRASH OR RUBBISH FIRES; AND <br />PROVIDING PENALTIES. <br />This bill had second reading. Council Member Adams made a motion to amend the bill, as amended <br />in the Committee of the Whole, seconded by Council Member Taylor. The motion carried. Council <br />Member Adams made a motion to pass the bill, as amended, seconded by Council Member Kopczynski. <br />The bill passed by a roll call vote of eight ayes. <br />BILL NO. 125 -77 A BILL APPROVING A CONTRACT BETWEEN THE BUREAU OF WATER <br />OF THE CITY OF SOUTH BEND, INDIANA, AND BASNEY FORD, <br />SOUTH BEND, INDIANA, FOR THE PURCHASE OF CERTAIN MOTOR <br />VEHICLES IN THE TOTAL AMOUNT OF $12,673.67. <br />This bill had second reading. Council Member Kopczynski made a motion to strike this bill, <br />seconded by Council Member Adams. The motion carried, with Council Member Szymkowiak opposing. <br />BILL NO. 135 -77 <br />A BILL APPROVING A CONTRACT BETWEEN THE BUREAU OF WATER <br />OF THE CITY OF SOUTH BEND, INDIANA, AND COLE ASSOCIATES, <br />INC., SOUTH BEND, INDIANA, FOR A RENOVATION FEASIBILITY <br />STUDY OF THE WATER WORKS BUILDING LOCATED AT 224 NORTH <br />MAIN STREET, SOUTH BEND, INDIANA, IN THE TOTAL AMOUNT <br />NOT TO EXCEED $3,500.00. <br />Council Member Kopczynski made a motion to defeat this bill, seconded by Council Member Adams. <br />The bill was defeated by a roll call vote of five ayes (Council Members Serge, Kopczynski, Adams <br />Horvath and Parent) and three nays (Council Members Szymkowiak, Miller and Taylor). <br />Council President Parent asked that a copy of the minutes relating to the Water Works be sent <br />to Mr. Stancati, in order that he will understand how the Council feels on these matters. <br />RESOLUTIONS <br />RESOLUTION <br />A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND SUPPORTING THE COMMITMENT OF PUBLIC SECTOR RESOURCES <br />TO THE CONTINUED DEVELOPMENT AND REVITALIZATION OF SOUTH <br />BEND'S CENTRAL BUSINESS DISTRICT. <br />A public hearing was held at this time on the resolution. Mayor Peter J. Nemeth indicated that <br />HUD had sent a letter requesting that certain items be presented before they would allow the <br />City to have 2.1 million in urgent need money. He said these resolutions were filed with the id <br />of complying with their requirements. <br />
