<br />Be it remembered that the Common Council of the City of South Bend met in the Council Chambers
<br />of the County -City Building on Monday, May 10, 1976, at 7:00 p.m., Council President Roger 0.
<br />Parent presiding. The meeting was called to order and the Pledge to the Flag was given.
<br />ROLL CALL PRESENT: Council Members Serge, Szymkowiak, Miller, Taylor,
<br />Kopczynski, Adams, Horvath and Parent
<br />ABSENT: Council Member Dombrowski
<br />Council President Parent announced that Council Member Dombrowski was attending a police seminar.
<br />Council Member Taylor made a motion to resolve into the Committee of the Whole, seconded by Counc:
<br />Member Miller. The motion carried.
<br />COMMITTEE OF THE WHOLE
<br />Be it remembered that the Common Council of the City of South Bend met in the Committee of the
<br />Whole on Monday, May 10, 1976, at 7:04 p.m., with eight members present. Chairman Frank Horvath
<br />presided.
<br />ORDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATION
<br />FROM THE GENERAL PARK FUND IN THE AMOUNT
<br />OF $75,000.00 TO ACCOUNT NUMBER 260.0 OTHER
<br />CONTRACTUAL SERVICES, GENERAL.
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and op-
<br />ponents were given an opportunity to be heard. Mr. James Seitz, Park Superintendent,made the
<br />presentation for the ordinance. He said this appropriation was for Pier Park, which is the con-
<br />necting park between Bicentennial and Island Park along the west bank of the river. He said low
<br />bids on the park totaled $68,322.40 above the engineer's estimate, which was made in 1973. He
<br />said the main reasons for the higher cost was price increases over the three year period, and the
<br />designs made in 1973 were preliminary and did not cover detail. He said the Park Department re-
<br />ceived approval of a $75,000.00 grant from the Bureau of Outdoor Recreation, and when the funds
<br />are received, we will deposit said funds in the General Park Fund. He said the Park Department
<br />was asking Council to appropriate $75,000 from the General Park Fund into account #260.0, Other
<br />Contractual Services, so the necessary funds will be available to complete Pier Park this year.
<br />Council Member Kopczynski asked if the work was to be continued by the firm that was being van-
<br />dalized, and how much cost was incurred because of this vandalism. Mr. Seitz said this was not
<br />the firm that was going to finish the work and he did not know the cost of the vandalism.
<br />Council Member Adams asked if this was the same $75,000 that was allocated in a Community Develop-
<br />ment hearing. Mr. Seitz indicated that this was the same $75,000 that was talked about, but it
<br />was not allocated. Council Member Adams asked what would happen if this does not receive approves
<br />Mr. Seitz indicated there would not be a complete park.
<br />Council Member Miller made a motion that this ordinance be recommended favorably to the Council,
<br />seconded by Council Member Serge. The motion carried.
<br />ORDINANCE AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS
<br />FROM THE MOTOR VEHICLE HIGHWAY FUND IN THE
<br />AMOUNT OF $25,000.00 TO ACCOUNTS 425.0
<br />CONCRETE AND 722.0 (PROPERTIES, MOTOR EQUIP-
<br />MENT).
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and op-
<br />ponents were given an opportunity to be heard. Mr.Joseph. Gawrysiak, Street Commissioner, made
<br />the presentation for the ordinance. He said a new truck is needed for the concrete crew that
<br />repairs street and curb cuts at manholes, catch basins, and inlets. He said the new truck will
<br />have a heavy -body construction to handle heavy concrete debris. He said funds were also being
<br />requested under this appropriation for concrete in an effort to correct the problem of maintenan
<br />of the concrete streets.
<br />Mr. Gene Evans, Executive Secretary of the Civic Planning Association, questioned Mr. Gawrysiak
<br />regarding the concrete account and the amount that was budgeted in 1976. Mr. Gawrysiak indicated
<br />that the Street Department had requested more money but it was cut from the budget. Mr. Evans
<br />asked about th Eplan for the replacement of truck equipment. Mr. Gawrysiak indicated that this
<br />truck was not in the budget and he did not believe there was a plan for replacement of equipment,
<br />but they were going to develop a plan.
<br />Council Member Horvath indicated that the Motor Equipment Fund for 1976 was cut because of the
<br />frozen tax rate, since this was the only place to cut. Council Member Kopczynski made a motion
<br />that this ordinance be recommended favorably to the Council, seconded by Council Member Szymkowi
<br />The motion carried.
<br />ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING
<br />CHAPTER 40 OF THE MUNICIPAL CODE OF SOUTH
<br />BEND, INDIANA (900 feet west of York Road
<br />and north of Kern Road).
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and op-
<br />ponents were given an opportunity to be heard. Mr. Ralph Stonebraker, Assistant Director of Area
<br />Plan, made the presentation for the ordinance. He said that this ordinance for rezoning was
<br />initiated by Area Plan, since this was land annexed into the City of March 1, 1976. He described
<br />the surrounding property, which is basically residential single family units and some farm propert
<br />to the south.

<br />Council Member Taylor indicated that this ordinance simply made it consistent with the other land
<br />surrounding. He made a motion that this ordinance be recommended favorably to the Council, secon ed
<br />by Council President Parent. The motion carried.
