<br />ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68,
<br />AS AMENDED, COMMONLY KNOWN AS THE ZONING
<br />ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA
<br />CHAPTER 21, MUNICIPAL CODE). (1803 S. Ironwood)
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and
<br />opponents were given an opportunity to be heard. Mr. R.W. Mysliwiec, attorney, 1800 American
<br />National Bank Bldg., made the presentation for the ordinance. He said they would like this
<br />property rezoned to C - commercial use and E - height. He said the property owners, Frank and
<br />Mary Deak, would like to put in a TV sales and service outlet. He said he thought the best use
<br />of the property was commercial. Council President Parent made a motion the ordinance be
<br />recommended to the Council favorably, seconded by Councilman Serge. The motion carried.
<br />ORDINANCE AN ORDINANCE DESIGNATING AND ESTABLISHING AN
<br />HISTORIC LANDMARK UNDER ORDINANCE NO. 5565 -73,
<br />AMENDING ORDINANCE NO. 4990 -68, AS AMENDED,
<br />COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE
<br />CITY OF SOUTH BEND.
<br />This being the time heretofore set for public hearing on the above ordinance, proponents were
<br />given an opportunity to be heard. Mr. John Oxian, Vice President of the Historic Preservation
<br />Society, made the presentation for the ordinance. He said the home should be considered an his-
<br />toric landmark for two reasons; it is architecturally superior, and its historic aspect as it
<br />dates back to 1880. He said the owner, Gerald Kline, fully understood all aspects of this being
<br />declared an historic landmark. Councilman Dombrowski made a motion the ordinance be recommended
<br />to the Council favorably, seconded by Councilman Szymkowiak. The motion carried. Council
<br />President Parent said he would like to commend Mr. Kline and the Historic Preservation Society
<br />for having this home declared an historic landmark.
<br />ORDINANCE AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 10,
<br />of the municipal code of the city of South
<br />BEND, INDIANA, BY THE ADDITION OF SECTION
<br />2 -47B PERTAINING TO REIMBURSEMENTS FOR
<br />ELECTIVE AND APPOINTIVE OFFICIALS, EMPLOYEES
<br />AND COUNCIL MEMBERS.
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and
<br />opponents were given an opportunity to be heard. Councilman Mary Chris Adams made the presenta-
<br />tion for the ordinance. She said this ordinance was being submitted to set up a procedure for
<br />reimbursement on city business. She said the Administration and Finance Committee found the
<br />ordinance favorable. Councilman Szymkowiak made a motion the ordinance be recommended to the
<br />Council favorably, seconded by Councilman Taylor. The motion carried. Council President Parent
<br />commended Councilwoman Adams for proposing this ordinance.
<br />ORDINANCE AN ORDINANCE TO APPROPRIATE $112,500 FROM THE
<br />LOCAL ROAD AND STREET FUND AND $12,500.00 FROM
<br />LINE ITEM 260.0 OF THE CUMULATIVE CAPITAL IM-
<br />provement fund to project R &S 48, PHASE III,
<br />IRONWOOD ROAD FROM APPROXIMATELY 500' SOUTH
<br />OF INWOOD ROAD NORTH TO NORTH OF RIDGEDALE
<br />ROAD.
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and
<br />opponents were given an opportunity to be heard Mr. Rollin Farrand, Director of the Department
<br />of Public Works, made the presentation for the ordinance. He said this ordinance was for the
<br />purchase of right -of -way for the improvement of Ironwood Road. He said this construction would
<br />run from approximately 1,000 feet north or Ireland to Ewing Avenue. He said it was anticipated
<br />that the construction project could be subdivided and constructed in stages. He said that
<br />upon approval of this ordinance, appraisals could be initiated leading to the actual making of
<br />an offer to purchase the property. He said the total construction cost for the project is
<br />$800,000. He said that public hearings on this project have been held. He indicated that traffi
<br />demands indicate a need to proceed. He said this project includes storm water retention near
<br />the intersection of Ironwood and Ridgedale Roads. He asked for favorable consideration of this
<br />ordinance. Councilman Taylor said he would recommend this be sent to the Council's Public Works
<br />Committee for further study. He indicated he did not question the need for improvement on Irnn-
<br />wood, but he would like to find out more about this project. He said there was need to sit down
<br />and talk about all the streets in the city. Councilman Taylor made a motion to send this ordinan
<br />to committee for further study, seconded by Councilman Dombrowski. Mr. Farrand said nothing has
<br />changed since the public hearing, the homes are the same. Councilman Taylor said he would like
<br />to look at the plans again to see who was going to be effected. Councilman Horvath asked
<br />Mr. Farrand if a two week delay would have any effect on the ordinance. Mr. Farrand said he was
<br />not going to press the point since they were not going to get started on this project this year,
<br />or possibly next year. The motion carried.
<br />ORDINANCE AN ORDINANCE TO APPROPRIATE $700,000 FROM
<br />THE LOCAL ROADS AND STREETS FUND AND $100,000.00
<br />FROM THE CUMULATIVE SEWER BUILDING AND SINKING
<br />FUND TO PROJECT R &S 85, MAPLE ROAD FROM LATHROP
<br />ROAD TO CLEVELAND ROAD.
<br />This being the time heretofore set for public hearing on the above ordinance, proponents and
<br />opponents were given an opportunity to be heard. Mr. Rollin Farrand, Director of the Department
<br />of Public Works, made the presentation for the ordinance. He said this ordinance was for the
<br />constructions and right -of -way purchase for Bendix Drive (Maple Road) from Lathrop to Cleveland
<br />Road, and Cleveland Road, for a distance of approximately one mile west of Bendix Drive. He
<br />said this work constitutes the City's share of the required match for EDA Funds, and is necessary
<br />to complete the project. He said the project costs are estimated at approximately $1,860,000.
<br />He said that in addition to serving the Industrial Park, this improvement will serve other
<br />commercial land along Bendix Drive and north of Cleveland Road. He asked for favorable conside-
<br />ration of the ordinance.
<br />Mr. Gene Evans, Executive Secretary of the Civic Planning Association, said he was curious about
<br />how many miles were involved. Mr. Farrand indicated about 50001on Cleveland and about a mile on
<br />Bendix Drive. Mr. Evans questioned the cost of $700,000 for two miles. He asked Mr. Farrand if
