<br />Councilman Horvath made a motion that the ordinances referred to in the reports be set for public
<br />hearing and second reading on December 16, 1974, seconded by Councilman Parent. The motion carri
<br />REPORT FROM THE DIRECTOR OF THE DEPARTMENT OF PUBLIC WORKS
<br />Mr. Rollin Farrand, Director of the Department of Public Works, submitted a written quarterly re
<br />to the Council members, indicating briefly the summary of the slurry seal program for 1974. He
<br />stated that it was anticipated that next year the program would be completed.
<br />IORDINANCES, SECOND READING
<br />(ORDINANCE NO. 5769 -74
<br />AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68,
<br />AS AMENDED, COMMONLY KNOWN AS THE ZONING
<br />ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA
<br />(CHAPTER 40, MUNICIPAL CODE) - northeast
<br />corner of Bendix Drive and Lathrop Street.
<br />This ordinance had second reading. Councilman Newburn made a motion to amend the ordinance to
<br />exclude a 100 -foot buffer zone to the north, with that buffer zone to remain "A" Residential,
<br />seconded by Councilman Horvath. The motion carried. Councilman Szymkowiak then made a motion
<br />that the ordinance pass, as amended, seconded by Councilman Newburn. The ordinance passed by a
<br />roll call vote of six ayes (Councilmen Szymkowiak, Miller, Kopczynski, Horvath, Newburn and Nemeth)
<br />and three nays (Councilmen Serge, Parent and Taylor).

<br />AN ORDINANCE TO AMEND SECTION 6 -6 OF THE
<br />MUNICIPAL CODE OF THE CITY OF SOUTH BEND,
<br />INDIANA, AS AMENDED.
<br />This ordinance had second reading. Councilman Horvath made a motion that the ordinance pass,
<br />seconded by Councilman Serge. The ordinance passed by a roll call vote of nine ayes (Councilmen
<br />Serge, Szymkowiak, Miller, Parent, Taylor, Kopczynski, Horvath, Newburn and Nemeth).

<br />AN ORDINANCE TRANSFERRING $1,488.02 FROM
<br />THE PARK DISTRICT BOND CONSTRUCTION FUND
<br />TO THE PARK DISTRICT BOND REDEMPTION FUND.
<br />This ordinance had second reading. Councilman Horvath made a motion that the ordinance pass,
<br />seconded by Councilman Serge. The ordinance passed by a roll call vote of nine ayes (Councilmen
<br />Serge, Szymkowiak, Miller, Parent, Taylor, Kopczynski, Horvath, Newburn and Nemeth).

<br />AN ORDINANCE APPROPRIATING THE SUM OF $5,800.00
<br />TO ACCOUNT NO. 241.0, "PRINTING, OTHER THAN
<br />OFFICE SUPPLIES ", AND THE SUM OF $7,500.00
<br />TO ACCOUNT NO. 260.0, "OTHER CONTRACTUAL
<br />SERVICES ", FROM THE PARKING METER FUND TO
<br />THE PARKING METER BUDGET OF THE CIVIL CITY
<br />OF SOUTH BEND, INDIANA.
<br />This ordinance had second reading. Councilman Newburn made a motion to amend the ordinance as
<br />amended in the Committee of the Whole, seconded by Councilman Taylor. The motion carried.
<br />Councilman Newburn then made a motion that the ordinance pass, as amended, seconded by Councilman
<br />Horvath. The ordinance passed by a roll call vote of nine ayes (Councilmen Serge, Szymkowiak,
<br />Miller, Parent, Taylor, Kopczynski, Horvath, Newburn and Nemeth).

<br />RESOLUTION NO. 455 -74
<br />A RESOLUTION FINDING AND ADJUDGING THAT
<br />THE FINANCING OF FACILITIES FOR SIMON
<br />BROS., INCORPORATED, AN INDIANA CORPORATION
<br />BY THE ISSUANCE BY THE CITY OF SOUTH BEND,
<br />INDIANA, OF ITS INDUSTRIAL DEVELOPMENT REVENUE
<br />BONDS PERTAINING TO SUCH FACILITIES FOR SUCH
<br />ENTITY WILL BE OF BENEFIT TO THE HEALTH OR
<br />WELFARE OF THIS MUNICIPALITY, AND APPROVING
<br />THE FINANCING THEREOF.
<br />WHEREAS, the Common Council of the City of South Bend., Indiana, heretofore has
<br />created the South Bend Development Commission, hereinafter referred to as "Commission ",
<br />pursuant to the provisions of the Public Law No. 183 of the Acts of the General Assembly
<br />of Indiana, for 1973, as such may be amended from time to time, including but not
<br />limited to IC 18- 6 -4.5 -2 through IC 18- 6- 4.5 -28, hereinafter referred to as the "Act ";
