Dear Council Members: I hereby Certify that the above referenced ordinance of City of South Bend Redevelopment Commission and Data Realty Northern Indiana LLC was legally advertised on Thursday, May 09, 2013 and that the Area Plan Commission at its public hearing on Tuesday, May 21, 2013 took the following action: Upon a motion by Daniel Brewer, being seconded by Robert Hawley and unanimously carried, the proposed ordinance of the City of South Bend Redevelopment Commission and Data Realty Northern Indiana LLC to zone from GI General Industrial District and PUD Planned Unit Development District to PUD Planned Unit Development District, property located at the southeast quadrant of Sample Street and Prairie Avenue, extending generally to Cotter Street on the South and Lafayette Boulevard on the east, containing 85 acres, City of South Bend, is sent to the Common Council with a favorable recommendation. The South Bend Comprehensive Plan, City Plan, identifies the establishment of a research parkas one of the action steps under Strategy #1. In conjunction with Notre Dame's Innovation Park, Ignition Park provides a well - designed development site for the attraction of new businesses. The changes proposed from the original PUD, preserves the overall intent of the development of Ignition Park. PLEASE NOTE that the Ordinance has been amended by the petitioner and is different than that used for the Common Council's first reading. The amended Ordinance was legally advertised and heard by the Area Plan Commission. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report.
