The meeting was called to order and the Pledge to the Flag was given. <br />ROLL CALL PRESENT Councilmen Serge, Szymkowiak, <br />Miller, Parent, Taylor, Kopczynski, <br />Horvath, Newburn and Nemeth. <br />ABSENT: None <br />Councilman Horvath made a motion to resolve into the Committee of the Whole, seconded by Councilmar. <br />Taylor. The motion curried. <br />COMMITTEE OF THE WHOLE MEETING <br />Be it remembered that the Common Council of the City of South Bend met in the Committee of the <br />Whole on Monday, October 21, 1974, at 7:04 p.m., with nine members present. Chairman Odell Newburn <br />presided. <br />ORDINANCE AN ORDINANCE PROHIBITING SMOKING AND THE <br />CARRYING OF LIGHTED OBJECTS UPON BUSES. <br />This being the time heretofore set for public hearing on the above ordinance, proponents and <br />opponents were given an opportunity to be heard. Mr. James Roemer, City Attorney, made the presen- <br />tation for the ordinance. He stated that Miss Kathleen Cekanski, one of his deputy attorneys, had <br />been instrumental in preparing the ordinance.- He indicated that there was nothing contained in the <br />Municipal Code which prohibited smoking on the city buses, thus the reason for the proposed <br />ordinance. Mr. Gene Evans, Executive Secretary of the Civic Planning Association, wondered if then <br />would be a problem with the words "municipally- owned buses" in the amended version of the ordinance <br />which had been submitted to the City Clerk. He felt the City of South Bend should be specified. <br />Mr. Roemer felt: the ordinance could be left as is and needed no further explanation regarding the <br />municipally -owned buses., Council President Nemeth wondered about the definition of the Public <br />Transportation Corporation. He suggested that the following wording be added in paragraph (a) in <br />the second line: "upon a bus owned by the City of South Bend or the South Bend Public Transportat: <br />Corporation ". Mr. Roemer indicated that he would have no objection to the addition of that phrase <br />Council President Nemeth made a motion to amend the ordinance by substituting the amended version <br />of the ordinance which would incorporate the issue into the Municipal Code, seconded by Councilman <br />Horvath. The motion carried. <br />Council President Nemeth then made a motion to further amend the ordinance to add the following <br />phrase in paragraph (a) in the second line: " upon a bus owned by the City of South Bend or the <br />South Bend Public Transportation Corporation ".
