3r wy ,' 3 <br />REGULAR MEETING OCTOBER 25 1982 <br />Commencing at the point of intersection of the north right -of -way line of Sample <br />Street with the east right -of -way line of Arnold Street; thence northerly along <br />and with the east right -of -way line of Arnold Street; thence northerly along <br />and with the east right -of -way line of Arnold Street a distance of 472.37 feet; <br />thence easterly along a line with a deflection angle of 90 degrees 07 minutes <br />30 seconds Right a distance of 201.44 feet to the point of beginning; thence <br />northerly along a line with a deflection angle of 90 degrees 07 minutes Left; a <br />distance of 387.02 feet; thence easterly along a line with a deflection angle <br />of 90 degrees, 13 minus Right, a distance of 17.92 feet; thence southerly to a <br />point of beginning; thence westerly a distance of 17.92 to the point of beginning. <br />WHEREAS, the Redevelopment Commission has conducted an investigation pursuant <br />to Section 2 -77 of the Municipal Code and prepared a report determining that there <br />is compliance with the Statutory obsolescence and eligibility criteria under Indiana <br />Code 6- 1.1- 12.1 -1 et seq. <br />WHEREAS, the Human Resources and Economic Development Committee of the Common <br />Council has reviewed said report and recommended to the Common Council that the area <br />qualifies as an Urban Development Area, and that the tangible personal property to <br />be located at such location is entitled to a deducation from the assessed value of <br />the equipment for a period of five (5) years. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, <br />Indiana, as follows: <br />SECTION I. The Common Council hereby accepts the report and recommendation of <br />the Human Resources and Economic Development Committee that the area herein described <br />be designated an Urban Development Area, and that the tangible personal property to <br />be located at such location is entitled to a deduction from the assessed value of <br />the equipment for a period of five years (5) years. <br />SECTION II. The Common Council hereby adopts a resolution designating this <br />area as an Urban Development Area for purposes of personal property tax abatement. <br />SECTION III. The Common Council directs the City Clerk, upon the receipt of <br />the report of the Area Plan Commission to cause notice of the adoption of this Resolution <br />to be published. Said publication shall provide notice of the public hearing before <br />the Common Council of said declaration. <br />SECTION IV. This Resolution shall be in full force and effect from and after <br />its adoption by the Common Council and approval by the Mayor. <br />Lewis A. Rick Carey, Senior Planner <br />in Redevelopment, indicated that Jamil Packaging Company was renovating an existing <br />building. He indicated that the real property improvements would be in the sum of <br />$334,000, and the tangible property would be in the sum of $160,000. He indicated <br />that seventeen new jobs would be created. Richard Cramer, attorney for the petitioners, <br />spoke in favor of these petitions. Council Member Szymkowiak made a motion to adopt <br />Resolution No. 1000 -82, seconded by Council Member Taylor. The resolution was adopted <br />by a roll call vote of nine ayes. Council Member Szymkowiak made a motion to adopt <br />Resolution No. 1001 -82, seconded by Council Member Taylor. The resolution was adopted <br />by a roll call vote of nine ayes. <br />Council Member Harris made a motion to combine public hearing on resolutions C & D <br />on the Agenda, seconded by Council Member Crone. The motion carried. <br />RESOLUTION NO. 1002 -82 <br />A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND DESIGNATING CERTAIN AREAS WITHIN THE CITY COMMONLY <br />KNOWN AS 1137 S. LAFAYETTE AS AN URBAN DEVELOPMENT AREA FOR <br />THE PURPOSES OF TAX ABATEMENT CONSIDERATION. <br />WHEREAS, a petition for real property tax abatement consideration has been <br />filed with the Common Council of the City of South Bend pursuant to Section 2 -76(a) <br />of the Municipal Code requesting that the area commonly known as 1137 S. Lafayette <br />and which more particularly described by a line drawn as follows: <br />Beginning at the SW corner of Lot 7, Stull's Second Edition, thence, N along <br />the E right -of -way of an alley a distance of 269.06 feet + or - to a point; <br />thence E a distance of 6 feet to a point; thence, N along a line parallel to <br />the Eastern right -of -way of said alley a distance of 54 feet to a point; thence, <br />W a distance of 6 feet to the eastern edge of said alley; thence N a distance <br />of 13 feet to a point, said point being the NW corner of the S 1/2 of Lot 64, <br />South Bend City Edition; thence, E along the northern boundry of said 1/2 of <br />Lot 64 which is on the western right -of -way of Lafayette Blvd.; thence, S a <br />distance of 275 feet + or - to the SE corner of Lot 6, Stull's Second Edition; <br />
