34 <br />REGULAR MEETING SEPTEMBER 13, 1982 <br />AND ALSO EXCEPTING thereform the right -of -way of the New Jersey, Indiana and Illinois <br />Railroad Company and the PennCentral Railroad, now known as Conrail. <br />Subject to all legal highways, the total parcel containing 70 acres more or <br />less. <br />is an Urban Development Area; and <br />WHEREAS, the Area Plan Commission has submitted to the'Council its written <br />ord-er approving the Declaratory Resolution to the. Council; and <br />WHEREAS, notice of the adoption of a Declaratory Resolution and the public <br />hearing before the Council having been published pursuant to Indiana Code 36 -7 -14- <br />17;`and <br />WHEREAS, the Council held a public hearing for the'purposes of hearing persons <br />in favor of the proposed project and those remonstrators who were opposed to the <br />proposed project; and <br />WHEREAS, the Council has determined the public utility and benefit -6f"the- pro_;_: <br />ject. <br />NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of South Bend, <br />Indiana, as follows: <br />SECTION I. The Common Council hereby confirms its Declaratory Resolution No. <br />986 -82 adopted by the Council on August 30, 1982, which designated the <br />area described hererein as a Urban Development Area for the purposes of Tangible <br />Personal Property tax abatement consideration and confirms its determination of the <br />project's public utility and benefit. <br />SECTION II. This resolution shall be in full force and effect from and after <br />its adoption by the Common Council and approval by the Mayor. <br />/s/ Lewis A. Jon Hunt, Director of <br />Redevelopment, indicated this was a reaffirmation of declaratory resolutions passed <br />by the ethanol plant. Council Member Beck made a motion to adopt Resolution No. <br />990 -82, seconded by Council Member Serge. The resolution was adop't'ed by" a- fdl -l' call' <br />vote of nine ayes. Council Member Szymkowiak made a motion to adopt Resolution No. <br />991 -82, seconded by Council Member Beck. The resolution was adopted by a roll call <br />vote of nine ayes. <br />RSOLUTION NO. 992 -82 <br />A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA, APPROVING THE AWARD OF THREE CONTRACTS IN <br />EXCESS OF $10,000.00 FOR THE REHABILITATION WORK -IN -THE. <br />COMMUNITY DEVELOPMENT PROGRAM THROUGH THE BUREAU OF <br />HOUSING'S REHABILITATION LOAN PROGRAM. <br />. WHEREAS, low bids for the rehabilitation work under the Community Development <br />Housing Rehabilitation Grant Program have.exceeded $10,000.00. <br />NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of South <br />Bend, Indiana: <br />1. Kathy Baumgartner, Director <br />of the Bureau of Housing, indicated tjat tje Loan Advisory Board and Redevelpoment <br />Commission have reviewed the bids and recommended the awarding of the contracts. <br />Council Member Beck made a motion to adopt this resolution, seconded by Council <br />Member Szymkowiak. The resolution was adopted by a roll call vote of nine ayes. <br />
