REGULAR MEETING NOVEMBER 23, 1981 <br />COMMITTEE OF THE WHOLE <br />Be it remembered that the Common Council of the City of South Bend met in the Committee <br />of the Whole on Monday, November 23, at 8:58 p.m., with nine members present. Chair- <br />man Voorde presiding. <br />BILL NO. 122 -81 <br />A BILL TO VACATE SUNNYMEDE AVENUE FROM THE EAST RIGHT -OF -WAY <br />LINE OF 35TH STREET EAST, FOR A DISTANCE OF 114' (ONE <br />HUNDRED FOURTEEN FEET), ALL BEING IN FERNWOOD ADDITION TO <br />CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA. <br />Now is the time heretofore set for public hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. Council Member Voorde read a letter <br />received from Holy Cross Systems stating they objected to this vacation. Steven <br />Drendall, 3503 Sunnymede, indicated that the land Holy Cross Systems owns would not <br />be landlocked by this vacation. Council Member Beck question if this portion of <br />Sunnymede had ever been used as a street. Mr. Drendall indicated it had never been <br />used as a street. She indicated that since it had never been used as a street, <br />perhaps it could legally belong to the property owners. Richard Hill, City Attorney, <br />indicated that would have to be researched. Council Member Beck made a motion to <br />table this bill indefinitely, seconded by Council Member Taylor. The motion carried. <br />BILL NO. 125 -81 <br />A BILL TRANSFERRING $306,691.71 FROM THE CUMULATIVE CAPITAL <br />IMPROVEMENT FUND TO THE POLICE DEPARTMENT WITHIN THE GENERAL <br />IMPROVEMENT FUND OF THE CITY OF SOUTH BEND, INDIANA. <br />Now is the time heretofore set for public hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. Joseph Kernan, City Controller, <br />made the presentation for the bill. He indicated this was a temporary transfer of <br />funds to reimburse the Police Department for the purchase of patrol cars. He indicated <br />they planned to use proceeds from the bond sale to reimburse this transfer. Council <br />Member Taylor made a motion to recommend this bill to the Council favorable, seconded <br />by Council Member Serge. The motion carried. <br />BILL NO. 126 -81 <br />A BILL APPROPRIATING $43,445.00 TO THE BUREAU OF SEWERS <br />BUDGET LINE ITEM 260 CONTRACTUAL SERVICES FROM THE SEWAGE <br />WORKS DEPRECIATION FUND FOR EMERGENCY SEWER REPAIRS ON <br />SAMPLE STREET AT THE RAILROAD CROSSING EAST TO THE FIRE <br />STATION. <br />Now is the time heretofore set for public hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. Mike Vance, Director of Utilities, <br />made the presentation for the bill. He indicated this appropriation would be used to <br />pay for the repair of the Sample Street sewer system, which runs on the north side of <br />Sample from the railroad crossing at Chapin east approximately 500 feet. He indicated <br />that the Board of Wastewater Commissioners declared an emergency situation and replaced <br />the entire 500 feet as opposed to making spot repairs, since this was not the first <br />time there was been a problem with that line. Council Member Taylor made a motion to <br />recommend this bill to the Council favorable, seconded by Council Member Serge. The <br />motion carried. <br />Council Member McGann made a motion to have public hearing on the next two bills at <br />this time, seconded by Council Member Dombrowski. The motion carried. <br />BILL NO. 127 -81 <br />A BILL APPROPRIATING $18,000.00 TO ACCOUNT 260, CONTRACTUAL <br />SERVICES, WITHIN THE BUREAU OF WATER BUDGET OF THE WATER <br />WORKS GENERAL FUND FOR THE DESIGN OF ADDITIONAL WATER <br />STORAGE AT THE EDISON PLANT AND APPROVING THE AWARD OF A <br />CONTRACT FOR SAID DESIGN BETWEEN THE BOARD OF WATER WORKS <br />COMMISSIONERS AND MCDONOUGH ENGINEERING, INC. <br />BILL NO. 128 -81 A BILL APPROVING A CONTRACT BETWEEN STREMMEL & HILL, INC., <br />AND THE BOARD OF WATER WORKS COMMISSIONERS IN THE AMOUNT OF <br />$113,985.00 FOR THE REPLACEMENT OF MEDIA AND REPAIR OF <br />FILTER NOZZLES AT THE EDISON FILTRATION. <br />Now is the time heretofore set for public hearing on the above bills, proponents and <br />opponents were given an opportunity to be heard. Michael Vance Director of Utilities, <br />made the presentation for the bills. He indicated these appropriations were for the <br />design improvements, and removal and replacement of filter media, and cleaning and <br />repair of filter nozzels at the Edison Park iron removal plant. He indicated that <br />the plant is 15 years old, and no media cleaning or nozzel replacement has taken <br />place. Council President McGann made a motion to recommend this bill to the Council <br />favorable, seconded by Council Member Dombrowski. The motion carried. <br />There being no further business to come before the Committee of the Whole, Councilmember <br />Dombrowski made a motion to rise and report to the Council, seconded by Council Member <br />Taylor.
