Honey Bee Keeping Regulations Ordinance <br />Page 5 <br />3. If the hive's entrance is within five feet (5') of the property line there must be <br />a solid wall, dense vegetation or combination of the two which extends five <br />feet (5') beyond the hive along the property line. <br />4. No hive shall be located closer than ten feet (10') from a public sidewalk. <br />5. Colonies may be kept on flat roofs without setback or flyaway barrier <br />restrictions. <br />(f) A constant supply of fresh, clean water shall be provided for all hives Design must <br />allow bees to access water by landing on hard surface. <br />(g) The honey bees and equipment shall be maintained in accordance with the applicable <br />provisions of the Indiana Code and apiga practices addressing honey bees recommended by the <br />State of Indiana's Apiary Inspector(s). <br />Sec. 5 -53 Honey Beekeeping Permit Required, Permit Fee, Denial or Revocation. <br />(a) Any person desiring to raise the common domestic honey bee limited to the Apis <br />mellifera species, must file an application for a Honey Beekeeping Permit with the Department of <br />Code Enforcement's Division of Animal Care and Control for review. <br />(b) A filing fee of twenty dollars (20) shall be required at the time of filing a completed <br />application. <br />(c) Prior to obtaining honey bees, a first -time applicant for a honey bee permit must <br />provide written proof to the Division of Animal Care and Control that he /she has completed <br />training or received information on beekeeping by an entity recognized by the Indiana <br />Department of Natural Resources Department of Entomology Division of Entomology & Plant <br />Pathology Purdue University. <br />(d) The Division of Animal Care and Control may deny or revoke a permit to any person <br />who has failed or refused to comply with the permit requirements, who has made any fraudulent <br />or false statement or material representation in the permit application • or in connection with the <br />keeping or maintenance of honey bees; or who has kept such honey bees in such a manner as to <br />constitute a breach of the peace or a menace to the health, safety or welfare of the public <br />(e) Upon denial or revocation of a permit the Law Department shall provide notice to the <br />4 A current "List of Assistance for Beekeeping in Indiana" may be accessed at www.in.jzov/dnr/entomolo/files/ep- <br />indiana. beekeeping information.pdf <br />
