REGULAR MEETING SEPTEMBER 15, 1980 REGULAR MEETING RECONVENED (CONTINUED A public hearing was held on the resolution at this time. Mr. Kenneth Fedder, attorney for the Economic Development Commission, indicated there was an expansion of the business on Taylor Street. He said five new jobs will be created. Council Member Szymkowiak made a motion to adopt this resolution, seconded by Council Member Dombrowski. The resolution was adopted by a roll call vote of nine ayes. RESOLUTION NO. 818 -80 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, AUTHORIZING THE BOARD OF WORKS TO NEGOTITATE THE SALE OF CITY -OWNED LOT LOCATED AT 233 ELDER.STREET. WHEREAS, the Board of Public Works of theCity of South Bend pursuant to the Municipal Code of the City of South Bend, Chapter 14.5, has offered for sale the following des- cribed property: Part of Lot "L" and part of the south 4 feet of Lot 21 of Elder Place Addition to South Bend, described as follows: Beginning at the south- west corner of said Lot "L" of Elder Place Addition; thence north 47 feet; thence east 37.05 feet; thence south 47 feet; thence west 37.05 feet to the place of beginning. at an offering price of $361.00; and WHEREAS, the Board of Public Works of the City of South Bend has now received -an offe to purchase the property at 233 Elder Street for a price of $50.00; and WHEREAS, the Board of Public Works has now complied with all requirements of the Municipal Code of the City of South Bend, Chapter 14.5, which establishes procedures for the disposition of real property owned by the City of South Bend, and more specificall real property valued by the Board at less than $1,000.00. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend that: SECTION I. The Board of Public Works be authorized-to negotiate a contract for the sale of Part of Lot "L" and part of the south 4 feet of Lot 21 of Elder Place Addition to South Bend, described as follows: Beginning at the south- west corner of said Lot "L" of Elder Place Addition; thence north 47 feet thence east 37.05 feet; thence south 47 feet; thence west 37.05 feet to the place of beginning, for a total price of Fifth Dollars ($50.00). SECTION II. This resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. /s /Lewis A. Mr. Patrick McMahon, Director of Public Works, indicated that the next door neighbor had been taking care of this pro- perty, and he has made an offer of $50 to purchase it. He said the $50 was all this person could afford. CouncilMember Dombrowski made a motion to adopt this resolution, seconded by Counci]Member Crone. The resolution was adopted by a roll call vote of nine ayes. RESOLUTION NO. 819 -80 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND APPROVING THE ISSUANCE OF A LICENSE FOR SCRAP AND JUNK DEALER (BREMEN IRON AND METAL COMPANY, INC.) WHEREAS, the Common Council of the City of South Bend recognizes the contr.ibutions:• that recycling operations such as junk and scrap yards make to the community; and the Council further _realizes that such operations must be reasonably regulated in order to minimize any environmental or aesthetic nuisances which may created by the operations of scrap and junk yards within the city; and WHEREAS, the Common Council of the City of South bend has enacted reasonable rules and regulations with regard to the issuance of licenses and the operation of the scrap and junk dealers; and WHEREAS, a petition by Bremen Iron and Metal Company, Inc., was submitted to the Board of Public Works on August 18, 1980, for the operation of a waste metal scrap operation on property located off of Sample Street immediately east of Webster Street and extending along and to the rear of the Penn Central Railroad tracks (more particularly described in a map attached to said petition); and WHEREAS, inspections of the property have been completed by the Environmental Protection Office and theFire Prevention Bureau; petitioner has agreed to conform with all of the rules and regulations pertaining to the operation of such scrap yards; and the Board of Public Works has approved the issuance of said license, all as required in finance No. 6621 -79. NOW, THEREFORE, BE IT RESOLVED by the CommonCouncil of the City of South Bend, Indiana, as follows: SECTION I. That the license application for Bremen Iron and Metal Company, Inc., for the operation of a scrap yard at the above location be approved, and the City Con- troller authorized to issue such license, however, said license shall be subject to the following conditions: 1 f 1
