JOHNSON <br />Executive Director <br />(219) 284 -9571 <br />September 20, 1978 <br />In Re: A proposed ordinance and site development plan of St. Joseph Bank and <br />Trust Company, to zone from "B" Residential, "A" Height and Area, to "C -1*1 <br />Commercial, "A" Height and Area, property located at the southeast <br />corner of Mishawaka Avenue and 34th Street, City of South Bend <br />Gentlemen: <br />The attached rezoning petition of St. Joseph Bank and Trust Company <br />was legally advertised September 9, 1978. The Area Plan Commission gave it a <br />public hearing on September 19, 1978, at which time the following action was taken: <br />"Upon a motion by June Stratton, being seconded by Harry Casad <br />and carried, with Joseph Serge voting "Nay ", the petition of <br />St. Joseph Bank and Trust Company, to zone from "B" Residential, <br />"A" Height and Area, to "C -1" Commercial, "A" Height and Area, <br />property located at the southeast corner of Mishawaka Avenue <br />and 34th Street, City of South Bend, is returned to the Common <br />Council with an unfavorable recommendation for the following <br />reasons: <br />a) The residential character of this stretch of Mishawaka <br />Avenue should be preserved and maintained, <br />b) There would be encroachment into the residential area <br />along 34th Street. <br />c) The Land Use and Transportation Plan recommends low <br />density residential. <br />If the site should be rezoned, the Commission recommends <br />that the east -west alley be the southern boundary of <br />commercial zoning." <br />If the Council should rezone this site, it shall have to be subject to <br />the submission of a final site plan. <br />The deliberations of the Area Plan Commission and points considered <br />in arriving at the above decision are shown in minutes of the public hearing <br />Serving: South Bend, Lakeville, New Carlisle, North Liberty, Roseland & St. Joseph, County, /N <br />
