KING TELEPHONE 233 -9449 TELEPHONE 6S4 -3722 <br />JOHN E.SPIGLE <br />July 28, 1978 <br />Clerk <br />South Bend Common Council <br />City - County Building <br />South Bend, Indiana 46601. <br />RE: Petition to Rezone Lot #22 of Swygart's <br />Third Addition, commonly known as 1825 <br />South Magnolia. <br />Dear Sir or Madam: <br />Please be advised that we are acting as counsel for Gruber <br />Super Markets, Inc., in connection with this firm's petition to <br />rezone the property described above from a residential to a com- <br />mercial area. The proposed use of the property is an off street <br />parking facility for the Gruber's Super Market located on 1847 <br />Prairie, which is immediately adjacent to the parcel. <br />We are transmitting herewith the required 30 copies of the <br />petition for rezoning in the form prescribed by the Area Plan <br />Commission, including a complete legal description of the sub- <br />ject property and a list of the names and addresses of all other <br />property owners within 300 feet of the proposed rezoning site. <br />At this time we are also providing a Preliminary Sketch Plan for <br />submission to the Area Plan Commission. Finally, we have provided <br />stamped envelopes addressed to each of the property owners listed <br />in the petition and the required filing fee of $10.00. <br />If everything is in order, please refer the matter to the <br />Area Plan Commission for its preliminary recommendation. The area <br />for which rezoning is sought adjoins a 16 foot alley. Proceedings <br />are currently underway to petition the Board of Public Works to <br />vacate this alley in order to expand the proposed parking area. <br />The proposed location has been reflected in the preliminary site <br />plan and should be brought to the attention of the Area Plan <br />Commission. <br />We thank you in advance for your courtesy and cooperation in <br />the matter.
