§ 91.032 ANIMALS IN VEHICLES. <br />No animal shall be leftunattended inavehicle when the conditions in that vehicle would <br />constitute a health hazard to the animal.Conditions include but are not limited to extreme <br />temperatures (hot/cold), hazardous material, confinement, or lack of provisionswhich <br />jeopardizesthe safety of the animal. <br />('74 Code, § 6-4(14)) (Ord. G-18-03, passed <br />5-27-03)Penalty, see § 91.999 <br />§ 91.033LOST OR STRAY ANIMALS. <br />(A)Persons finding a stray animal are to notify the Department of Animal Control within <br />48 hours. At the discretion of the department, the animal may be kept by the finder and a found <br />report left with the department, to enable the finder an opportunity to return the animal to its <br />rightful owner. <br />(B)Upon demand by the Department of Animal Control, any found animal will be <br />surrendered to the department and held for three working days, before a disposition is made. <br />(C)Persons finding an animal are obligated to comply with all rules and regulations of this <br />chapter pertaining to humane care and treatment of animals, while said animal is in their custody <br />awaiting return to its actual owner. <br />(D)With the exception of the Allen County S.P.C.A., the finder will be considered the <br />found animal's owner for the purposes of this chapter only after the animal is in the finder's <br />custody for 30 continuous days and has been presented for microchip scanning. <br />('74 Code, § 6-5)(Ord. G-18-03, passed 5-27-03) <br />§ 91.034DANGEROUS ANIMALS PROHIBITED. <br />(A)Potentially dangerous dogs.Classification of a dog as potentially dangerous shall be <br />based upon specific behaviors exhibited by the dog and defined injuries caused by the dog. These <br />levels are not a progression and nothing shall prohibit the court from starting at any level. For <br />purposes of this chapter, injuries and behaviors are defined in various levels of potentially <br />dangerous dogs.Upon finding by the court that a violation of this section has occurred the court <br />shall declare the behavior to fall within one of the following levels and impose upon the owner/ <br />harborer of the dog the following conditions: <br />(1)Level 1 behavior is established if a dog isrunning at largenot legally restrainedand <br />causes injury to another animal or human that results in an oral scratch or less thenthanfour <br />punctures.
