City of South Bend Community Investment <br /> Environment - Considers whether the properties have active violation(s) or otherwise present a danger to public <br /> health and safety. <br /> Resolution for Approval: <br /> The following applicants were inspected and received favorable recommendations from City departments: <br /> • OmniSource LLC - 1305 Prairie Ave. <br /> • Paul's Auto Yard - 3300 S. Main St. <br /> • Stevie's Enterprises - 3109 S. Gertrude <br /> Because the above applicants have met all the requirements of the ordinance, the attached resolution approving <br /> licenses is respectfully submitted for your consideration. <br /> Resolution for Interim Grant: <br /> The following applicants were inspected and reviewing departments identified deficiencies: <br /> • LKQ Pick Your Part Midwest, LLC - 1602 S. Lafayette Blvd. <br /> • Big Bulldog Auto Parts - 3700 S. Gertrude St. <br /> • Alternative Two, LLC - 700 W. Chippewa Ave. <br /> • Republic Services - 2500 Green Tech Dr. <br /> The deficiencies referenced above either do not rise to a level that would necessitate denial of the license at this <br /> time, and/or that it is appropriate for the City to grant additional time for compliance. The deficiencies needing <br /> to be corrected are as follows: <br /> • LKQ Pick Your Part Midwest, LLC: Compliance with required LeadsOnline electronic reporting to SBPD. <br /> • Big Bulldog Auto Parts: Compliance with required LeadsOnline electronic reporting to SBPD. <br /> • Alternative Two, LLC: Demonstration of compliance with the Indiana Department of Environmental <br /> Management (IDEM) for active violations of Indiana and Federal environmental law and continued <br /> compliance with the South Bend Fire Department to complete work on their Fire suppression system. <br /> • Republic Services: Continued compliance with the South Bend Fire Department to complete work on their <br /> Fire suppression system. <br /> Under Sections 4-6, 4-16, and 4-51 of the South Bend Municipal Code, the Common Council is authorized to <br /> condition the issuance of a business license to ensure that operations do not pose a nuisance or hazard and are <br /> conducted in compliance with all applicable fire, health, environmental, and public safety laws. Section 4-51 <br /> further contemplates the issuance of interim licenses, including time-limited licenses and extensions, as a <br /> regulatory tool. <br /> Accordingly,the enclosed Resolution proposes issuance of an interim license,subject to clearly defined,objective <br /> compliance requirements and a fixed duration. This approach allows the Applicants an opportunity to achieve full <br /> compliance while preserving the City's enforcement authority and protecting public health,safety, and welfare. <br /> The Resolution further provides that, upon written certification by the Business License Administrator that all <br /> conditions have been satisfied, the interim license shall automatically convert to a full scrap metal dealer license <br /> for the remainder of the applicable license term, without the need for additional Council action.This certification <br /> function is ministerial in nature and does not delegate licensing discretion from the Common Council. <br /> Failure to satisfy the conditions within the specified timeframe constitute grounds for revocation of this interim <br /> license without further Council action.
