<br />traffic into the area. Jim Childs, a local architect, spoke in favor of this 
<br />rezoning. Ray Brock, chairman of the Council Oak Neighborhood Group, spoke against 
<br />this rezoning. John Leszczynski, City Engineer, indicated they do not plan to 
<br />signalize this area. He indicated they would anticipate building a new passing 
<br />zone. Council Member Taylor made a motion to recommend this bill to the Council 
<br />favorable, seconded by Council Member Voorde. The motion carried.

<br />A BILL ANNEXING AND BRINGING WITHIN THE BOUNDARIES OF 
<br />THE CITY OF SOUTH BEND, INDIANA, CERTAIN REAL ESTATE 
<br />LOCATED WITHIN PENN TOWNSHIP, ST. JOSEPH COUNTY, 
<br />INDIANA. 
<br />This being the time heretofore set for public hearing on the above bill, proponents 
<br />and opponents were given an opportunity to be heard. Council Member Taylor made the 
<br />presentation for the bill. He indicated That Hilltop Lutheran Church is an island 
<br />at this time. He indicated that the City had property to the east and west of the 
<br />church. He indicated that fire and police were already answering calls at the 
<br />church. Council Member Puzzello made a motion to recommend this bill to the Council 
<br />favorable, seconded by Council Member Zakrzewski. The motion carried. 
<br />BILL NO. 144 -84 A BILL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING 
<br />CHAPTER 4, ARTICLE 4, OF THE MUNICIPAL CODE OF THE CITY 
<br />OF SOUTH BEND, BY THE INCLUSION OF NEW SECTION 4 -23 
<br />ENTITLED FERTILIZER MANUFACTURERS. 
<br />This being the time heretofore set for public hearing on the above bill, proponents 
<br />and opponents were given an opportunity to be heard. Council Member Crone made the 
<br />presentation for the bill. Council Member Taylor made a motion to amend the bill by 
<br />substitution on file with the City Clerk, seconded by Council Member Voorde. The 
<br />motion carried. Council Member Crone indicated that for the last several months she 
<br />had been meeting with members of neighborhood organizations, Carolyn Pfotenhauer, of 
<br />the City Attorney's office, Katherline Barnard, Code Enforcement, and Kathy 
<br />Cekanski- Farrand, Council Attorney, in an attempt to draft a bill that would address 
<br />the possibility of a fertilizer manufacturing operation locating within the City of 
<br />South Bend. She indicated it was the general consensus that because of the many 
<br />health and safety considerations involved reasonable licensing requirements should 
<br />be enacted to protect the public interests. She indicated this bill sets forth 
<br />certain licensing standards which all such operations would have to meet before 
<br />beginning operation. Council Member Taylor made a motion to recommend this bill to 
<br />the Council favorable, as amended, seconded by Council Member Zakrzewski. The 
<br />motion carried. 
<br />There being no further business to come before the Committee of the Whole, Council 
<br />Member Taylor made a motion to rise and report to the Council, seconded by Council 
<br />Member Puzzello. The motion carried.

<br />bill, seconded by Council Member Taylor. The bill passed by a roll call vote of 
<br />nine ayes.
