REGULAR MEETING <br />F <br />OCTOBER 22, 1984 <br />along the South line of said Lot 14, a measured distance of 165.0 feet to the <br />place of beginning containing 0.45 acres more or less. <br />Lots Numbered Eleven (11) through Eighteen (18) both inclusive, as shown on the <br />recorded Plat of Perley Lumber Company's Addition to the City of South Bend, in <br />St. Joseph County, Indiana, as recorded in Plat Book 8, page 166, together with <br />the North Half of the vacated alley lying South of and adjacent to Lot 11 in <br />said Addition and together with the vacated alley lying West of and adjacent to <br />said Lots 11 to 18, both inclusive, in said Addition. <br />Lot Numbered Fifteen (15) as shown on the recorded Plat of Stover and Witwer's <br />Addition to the Town of Myler, now within and a part of the City of South Bend, <br />together with the South Half of the vacated alley lying North and adjacent to <br />said Lot 15 in said Addition and together with the vacated alley lying West of <br />and adjacent to said Lot 15 in said Addition. <br />Subject to all real estate taxes, including without limitation, the taxes for <br />the year 1983 due and payable in 1984 and all prior and subsequent taxes. <br />as an Economic Revitalization Area; and <br />WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing <br />before the Council has been published pursuant to Indiana Code 6- 1.1- 12.1 -2 -5; and <br />WHEREAS, the Council held a public hearing for the purposes of hearing all remonstrances <br />and objections from interested persons; and <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, <br />Indiana, as follows: <br />SECTION I. That the Common Council hereby confirms its Declaratory Resolution <br />designating the area described herein as an Economic Revitalization Area for the <br />purposes of tax abatement. Such designation is for personal property tax abatement <br />only and is limited to five (5) calendar years from the date of adoption of the Declaratory <br />Resolution by the Common Council. <br />SECTION II. This Resolution shall be in full force and effect from and after <br />its adoption by the Common Council and approval by the Mayor. <br />/s/ Beverlie J. Beck <br />Member of the Common Council <br />A public hearing was held on the resolutions at this time. Ernest Szarwark, attorney, <br />indicated Wells'Electronics was expanding their facility. He indicated this proposed <br />tax abatement meets the criteria currently established by the Common Council. Council <br />Member Zakrzewski made a motion to adopt Resolution No. 1217 -84, as amended, seconded <br />by Council Member Crone. The resolution was adopted by a roll call vote of seven <br />ayes. Council Member Zakrzewski made a motion to adopt Resolution No. 1218 -84, as <br />amended, seconded by Council Member Crone. The resolution was adopted by a roll call <br />vote of seven ayes. <br />Council Member Crone made a motion to amend 9C in the title by adding real property, <br />seconded by Council Member Voorde. The motion carried. <br />Council Member Crone made a motion to amend 9D in the title by adding personal property, <br />seconded by Council Member Zakrzewski. The motion carried. <br />Council Member Braboy made a motion to combine public hearing on 9C & 9D, seconded by <br />Council Member Crone. The motion carried. <br />RESOLUTION NO. 1219 -84 <br />A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY RESOLUTION <br />DESIGNATING CERTAIN AREAS WITHIN THE CITY OF SOUTH BEND, <br />COMMONLY KNOWN AS 3607 SOUTH MAIN STREET TO BE AN ECONOMIC <br />REVITALIZATION AREA FOR PURPOSES OF REAL PROPERTY TAX ABATEMENT. <br />WHEREAS, the Common Council of the City of South Bend has adopted a Declaratory <br />Resolution designating certain areas within the City as Economic Revitalization Areas <br />for the purpose of tax abatement consideration; and <br />WHEREAS, a Declaratory Resolution designated the area commonly known as 3607 <br />South Main Street and more particularly described by a line drawn as follows: <br />Lots 1 thru 5 as shown on the plat of Ida M. Walz's Subdivision to the City of <br />South Bend, Indiana recorded October 13, 2938 in Plat Book 14, page W -5 and Lots <br />"D" and "E" as shown on the plat of John E. Walz's Revised Addition to the City <br />of South Bend recorded June 28, 1928 in Plat Book 12, page 196 together with <br />vacated Lafayette Boulevard and vacated alleys lying between the adjacent to <br />above said recorded lots and also a parcel of land 28 feet North and South by <br />211.75 feet, more or less, East and West in the Southwest 1/4 of the Southwest <br />1/4 ot"'Section 24, Township 37 North, Range 2 East, Portage Township, City of <br />South Bend, County of St. Joseph, Indiana lying South and adjacent to above said <br />
